As Ms Lunn has admitted the breach of the rule it is deemed to be proved.

Penalty:

Ms Lunn is suspended from race riding from the conclusion of racing on Sunday 29th April 2012 until the conclusion of racing on Friday 1st June 2012.

Charge:

Alleged that Apprentice C Lunn failed to ride her mount "Foneeleven" out to the end of the race.

Facts:

Mr Neal told the hearing how Ms Lunn on "Foneeleven" obtained a rails run in the home straight. She said that she rode with considerable vigour, steadily improving on the inside of "Our Genes" until a point where she was on even terms with "Our Genes". Mr Neal said that the Stipendiary Stewards had no complaint about her ride up to this point of the race. However, with approximately one and a half to two strides from the winning post, Ms Lunn relaxed her vigorous ride and "stood up" in the stirrups. Her mount finished in a dead-heat for first place, Mr Neal said that had she not relaxed her ride at that crucial time that there was, in his words, "a high probability" that her horse would have won the race outright, instead of having to share first place. He demonstrated the incident using the head-on and side-on camera views.

Mr Beckett said that Ms Lunn had been trying to get her fitness level up and that she was inexperienced and still had issues to work through with regard to her riding, particularly with the finishing stages of a race generally.

Submissions for Penalty:

Mr Neal submitted that Ms Lunn had not breached this rule in the last twelve months but had done so at Kurow in December 2010 when she dead-heated for third place. Ms Lunn has changed stables, and was working on her riding skills. He advised the hearing that in recent times, that there was no case whereby first position had been lost. He submitted that given the gravity of the offending that a suspension of eight weeks should be imposed.

In response, Mr Beckett said that an eight week suspension was far too tough having regard to her lack of experience. Ms Lunn said that in the last twelve months that she had only had about 20 rides.

In reponse to a question from the panel, Mr Neal agreed that Ms Lunn would probably only have been able to hit the horse once, possibly twice, in the last stride or two of the race. He agreed that Ms Lunn had made an error of judgement.

Reasons for Penalty:

Ms Lunn did not ride her horse out to the end of the race. That is the essence of the charge and Ms Lunn has admitted her breach of the rule.

Mr Neal submitted that an eight week suspension should be imposed. The starting point for a breach of this rule, according to the penalty guide is a suspension of three calendar weeks. However, we take into account the fact that Ms Lunn may have lost the opportunity of finishing in first place outright, and that is an aggravating feature which means an uplift on the starting point of two weeks, making the period of suspension, five weeks. Against that we take into account Ms Lunn's inexperience, her vigorous ride up to the point where she made a serious misjudgement, and the fact that Ms Lunn has admitted the charge at the earliest opportunity. Taking those factors as mitigating factors we are able to afford a discount of one week, making the period of suspension approximately four weeks. The period of suspension will mean that Ms Lunn will be suspended from race riding at Riverton 1st May, CJC 5th May, South Canterbury 11th May, Ashburton 15th May, Winton 18th May, Gore 22nd May, CJC 25th May and CJC 1st June, 2012.
