The parties were advised that “Katriffic” was declared to be a non-starter and that dividends were to be paid according to the amended placings, which were as follows:

1st - Miss Elise (9)
2nd - Captain Montoya (3)
3rd - Champagne Eva (8)
4th - Seasoned Gem (1)
5th - Flynn (4)
6th - Tana Geesh (5)

Facts:

At the commencement of these proceedings Mr Hales declared a conflict and withdrew from the hearing.

Following the running of Race 1, the Consult Your Vet Maiden, an information requesting a ruling was filed by Stipendiary Steward Mr R. Neal as to whether “Katriffic” (6) should be declared a non-starter.

The information reads as follows:

“I the above named informant seek a ruling in relation to Rule 632 from the Judicial Committee (as to whether) Katriffic’s barrier was slow to open resulting in Katriffic being denied a fair start.

Rule 632 reads as follows:

“If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Mr Neal gave evidence and used video coverage to show that the outside gate (gate 7) was slow to open in this race. It was also shown that the gate only opened when it was forced open by “Katriffic”, and that as a result this horse missed the start of this 1000 metre race by some distance. “Katriffic” finished 4th in the race, about 2½ lengths from the winner.

Ms J. L. Morris, the rider of “Katriffic”, gave evidence that she would have missed the start by 10 to 12 lengths, and that she would have won the race otherwise.

Mr Stokes accepted that his horse’s chances had been badly affected by the starting gate malfunction.

After hearing the evidence Mr Neal made submissions that “Katriffic” should be declared a non-starter in the race.

Reasons for Decision:

It was clear from the evidence that “Katriffic” was prevented from taking an effective part in this race because of the mechanical failure of starting stalls. I was therefore satisfied that “Katriffic” should be declared a non-starter.
