The Committee ruled that horse No.2, VENETIAN RAIDER, had been prevented from taking an effective part in the race due to a mechanical failure of its starting stall. It was ordered that it be declared a non-starter.
It was further ordered that dividends for the race be amended accordingly.
Facts:
Following the running of Race 2, Classic Hits Marlborough Rating 85, an information was filed by Stipendiary Steward, Mr N M Ydgren, requesting a ruling under Rule 632 as to whether VENETIAN RAIDER (B Pitman) should be declared a non-starter “in that the barrier of VENETIAN RAIDER was slow to open”.
Mr M R Pitman, trainer of VENETIAN RAIDER, was present at the hearing of the information along with jockey, Mrs B Pitman, and starter, Mr G A Phillips.
Rule 632 provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.
Submissions for Decision:
Mr Ydgren showed head-on and side-on video replays of the start of the race, a 1000 metres Rating 85 event. He pointed out VENETIAN RAIDER, ridden by Mrs Pitman, drawn the outside gate in the 7-horse field. Mr Ydgren submitted that there was “some delay” in the outside gate of VENETIAN RAIDER opening. Mr Ydgren submitted that it was significant that the race was over 1000 metres, where any disadvantage at the start of the race would affect the chances of the horse concerned. The horse was last to jump and lost at least 2 lengths in doing so, he said.
Mr Pitman said that the horse races best when in front and was denied the opportunity to leave the gate quickly, and stopped at the end of the race after having had to “work extremely hard”. He said that the horse settled down outside the leader but had to do too much work. It finished in last placing, approximately 13 lengths from the winner. If the horse jumps, it will relax and “kick”, Mr Pitman said. In this race, it had to work all the way and got in a “dogfight” with the leader and failed to run on.
Mr Ydgren said that the Stewards supported the horse being declared a non-starter.
Reasons for Decision:
The Committee was satisfied that there had been a mechanical failure of the starting stall of VENETIAN RAIDER, in that it failed to open simultaneously with the other stalls. As a consequence, VENETIAN RAIDER was slow to begin, losing 2-3 lengths at the start, which prevented it from taking an effective part in the 1000 metres race.
