Information No. 69511 was filed by Stipendiary Steward, Mr A L Ray, against Licensed Trainer (Class A), Mr P D J Harris, alleging a breach of Rule 534 (2) (a) in that Mr Harris, as the trainer of KEEPITINTHEFAMILY, an acceptor for Race 2, Strait Shipping/Riverby Estate Rating 75, “failed to scratch KEEPITINTHEFAMILY by the prescribed time”.

Mr Harris had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.

Submissions for Decision:

Mr N M Ydgren, Stipendiary Steward, informed the Committee that the scratching deadline for the race meeting was 7.30am on raceday. Mr Harris had notified the scratching of KEEPITINTHEFAMILY, trained by him, an acceptor for Race 2, approximately 15 minutes after that time. Mr Harris had explained to the Stipendiary Stewards that he had not brought the horse to the meeting and he had intended to scratch it earlier, but had simply forgotten to do so. No other runner was denied a start as a result of Mr Harris’ omission, Mr Ydgren said.

Submissions for Penalty:

Mr Ydgren said that he would leave the matter of penalty to the Committee.

Reasons for Penalty:

The Committee, in determining penalty, took into account as mitigating factors Mr Harris’ admission of the breach, the fact that no other horse was denied a start, that he was only 15 minutes late in notifying the scratching and, finally, that it was clearly an oversight on his part.

The Committee also had regard to penalties imposed in other cases of a breach of the Rule which ranged from $200 to $350.
