We therefore determined that Miss Williams’ licence to ride be suspended from the conclusion of racing on 27 April 2014 up to and including 3 May 2014 which encompasses the days racing at Riverton on 1 May and Canterbury on 3 May 2014.
Facts:
Following the running of Race 4, the More FM Maiden, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class A Rider, Miss K Williams, the rider of TRICIA’O, alleging careless riding near the 1100m when she improved her mount forward and in doing so dictated HOME MADE HALO (Miss J Morris), inwards causing both REDESDALE (D Walsh) and HARPER ROSE (K Myers) to be checked.
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Miss Williams had indicated on the Information that this breach of the Rules was not admitted and she confirmed this at the hearing. Miss Williams also agreed that she understood the charge and the Rule it was brought under.
Submissions for Decision:
Mr McLaughlin gave evidence and used video coverage, with the assistance of Stipendiary Steward Mr M Zarb, to show that near the 1100m, TRACIA’O, ridden by Miss Williams was racing in a 4 wide position with HOME MADE HALO (J Morris), REDESDALE (D Walsh) and HARPER ROSE (K Myers) racing on the inner. Mr Zarb pointed out Miss Williams a head to a neck ahead of Miss Morris with Mr Walsh about ¾ of a length behind and Miss Myers on his quarters. On the point of the turn into the back straight Mr McLaughlin alleged that Miss Williams was improving forward to take the lead and when doing so shifted in dictating Miss Morris inwards onto Mr Walsh and Miss Myers and as a result, both had to check.
Miss Morris gave evidence and stated that she received pressure from the outside horse ridden by Miss Williams who dictated her inwards onto Mr Walsh and Miss Myers.
Mr Walsh gave evidence and stated that when the incident occurred both horses came across into his line abruptly and together. He was unable to clearly say who had caused the interference.
Miss Williams, when given the opportunity during the hearing, declined to ask any questions of Miss Morris or Mr Walsh.
Miss Williams gave evidence and stated that her horse jumped well and was having its first start in blinkers. In previous starts the horse had no early speed and with the addition of blinkers the connections had hoped to rectify this. She stated that she finished up handy and wide over the early stages and was hoping that one of the inside runners would go forward to take the lead so she could slot in. Miss Williams said that she could see no other horse wanting to take the lead so she opted to improve forward on the outer. She said that as she was improving forward Miss Morris decided to go with her. She stated that she had not put any pressure on HOME MADE HALO and that Miss Morris’ horse had shifted away from TRACIA’O with her horse following it in. She submitted that she was driving her horse forward to get around the corner and had not dictated Miss Morris’ line inwards.
Miss Williams also stated that the horse had hung in for most of the race and had proved difficult to control with her changing her whip to the left hand near the 600m.
Reasons for Decision:
We carefully considered the evidence given and the video coverage of the incident. The Committee was satisfied that REDESDALE and HARPER ROSE had to check near the 1100m when racing on the inside of TRICIA’O and HOME MADE HALO. The Committee took into consideration the video evidence in this case which was of some assistance, the evidence from Mr Walsh that both horses came across together and the incident had happened suddenly, combined with Miss Morris evidence that inward pressure had come from Miss Williams’ horse. The Committee were satisfied that Miss Williams had dictated HOME MADE HALO inwards onto REDESDALE and HARPER ROSE who both had to check and therefore find the charge proved.
Submissions for Penalty:
Mr McLaughlin stated that the Stewards would consider the degree of carelessness and consequences in this incident to be at the lower end of the scale. He stated that REDESDALE had finished up winning the race with HARPER ROSE finishing in 5th place. Miss Williams, he said, had a clear penalty record which he described as excellent. Mr McLaughlin submitted that after taking all factors into consideration a minimal 2 day suspension be considered as penalty.
Miss Williams submitted that a minimal term of suspension be considered as penalty and sought a deferment of penalty until after racing at Blenheim on Sunday 27 April.

In determining penalty the Committee took into consideration Miss Williams’ excellent penalty record, the fact that she is a South Island rider and the degree of carelessness and consequences we determined to be low. Taking the JCA Penalty Guide recommended starting point of 5 days we were able to give a discount of 1 day for the fact that Miss Williams is a South Island rider. We were also able to give a discount of 1 day for her excellent penalty record and a further discount of 1 day for the fact that the carelessness and consequences were at a low level. We therefore determined that a 2 day suspension was an appropriate penalty.
The Committee also granted a deferment of penalty for 3 days with the suspension beginning after racing on 27 April 2014.
