As Mr Price has admitted the breach it is found to be proved.
Penalty:
Mr Price is fined $200.
Facts:
Following the running of race 1, the “Crafar Crouch Construction Maiden Mobile Pace” Information A5711 was filed by Stipendiary Steward Mr J McLachlan under Rule 869(2)(a). The information stated “you used your whip excessively over the final stages”. Mr Price signed the information admitting the breach and that he did not wish to be present during the hearing.
Rule 869(2)(a) states:- “No horseman shall during any race use his whip in an unnecessary, excessive or improper manner.”
Submissions for Decision:
Mr Wallis used the head-on film to identify Mr Price driving “Sombrero Man” against the rail and leading the race at the top of the home straight. He said Mr Price struck his horse 5 times, paused and then used his whip approximately a further 25 times in the run to the finish. Mr McLachlan said that many of the latter strikes were on the dust sheet and sulky but the total number of strikes was too many.
Submissions for Penalty:
Mr McLachlan said this was Mr Price’s first breach of this Rule and that he had limited driving opportunities and had admitted the breach at the earliest opportunity. He submitted a fine of $200 was an appropriate penalty.
Reasons for Penalty:
The Committee has reviewed the film of the incident and notes Mr Price used his whip approximately a total of 30 times in the home straight with many of the strikes being on the dust sheet or sulky. Whilst the number of strikes is clearly excessive many of them were not that forceful and we therefore believe the breach of the rules is at the low end of severity. We also note this is Mr Price’s first breach of this Rule and that he has only a small number of drives each season. Finally we have reviewed recent penalties for similar recent breaches of this Rule to ensure we are consistent in determining the appropriate penalty. We believe on this occasion a fine is an appropriate penalty.
