In relation to race one on the programme, an Information was lodged against trainer, Mr G Barlow, alleging a breach of Rule 868(5)(a), in that he was late obtaining permission to race How Easy without sidewinkers.

Mr Barlow admitted the breach and elected not to be present.

Explaining the circumstances, Mr Ching said that, prior to race one, Mr Barlow approached the stipendiary stewards indicating that his horse, How Easy, had come back from a spell and raced at trials without sidewinkers. He had intended racing it at the race meeting without sidewinders but had omitted to gain permission as required by the Rules.

Given Mr Barlow thought his horse would not perform well with them on, the stewards allowed him in this instance to start without sidewinkers but, in so doing, the permission was not granted by the required time and he was charged under this Rule. In respect to penalty, he recommended a fine in the order of $100.00, in keeping with similar breaches.

In this case, trainer Mr G Barlow has admitted a breach of Rule 868(5)(a), in that he was late obtaining permission to race his horse, How Easy, without sidewinders. The circumstances have been explained by Mr Ching and, in the absence of submissions from Mr Barlow, we are satisfied the recommended penalty in this instance is appropriate, and Mr Barlow is fined the sum of $100.00.
