Hearing and Decision:

--

--

Following the running of Race 6, a protest was lodged by the Stipendiary Stewards against horse number 1, Beach Assault (M P Jones), placed 5th by the Judge, on the grounds of interference. The Information alleged that Beach Assault broke with approximately 500metres to run, checking Smooth Eric (R Anderson) and Top Star (R Fensom), causing both these horses to lose their chance in the race.

--

--

However, following the presentation of the Information, the Chief Stipendiary Steward, Mr N Escott, sought an amendment to that Information to delete Smooth Eric (R Anderson) and substitute it with Rock Patron (C Thornley) as the second horse affected by the alleged interference. The Information was so amended.

--

The placings were: 1st - No 8, 2nd - 5, 3rd - 6, 4th - 11, 5th - 1, 6th - 2.

--

--

Presenting his evidence, Mr Escott referred to the video of the race which showed that, at about the 500metre mark, Beach Assault (M P Jones) on the inside and toward the back of the field, broke free of interference, checking the two trailing horses, Top Star and Rock Patron, causing them to lose all chance in the race. Beach Assault recovered to finish in 5th place. In this case, Mr Escott sought the disqualification of Beach Assault.

--

--

Driver of Beach Assault, Mr Jones, representing the connections, indicated he did not wish to contest the protest and, as a consequence of the interference to the other horses, accepted that Beach Assault should lose its placing in the race.

--

The Committee was satisfied that that decision was appropriate and, accordingly, the protest was upheld, and Beach Assault was disqualified from the race. The placings are now:-

--

1. 8 Sky City Blue Jean

--

2. 5 Spirit of the Doll

--

3. 6 Irish Storm

--

4. 11 No Negate Franco

--

5. 2 Schivas Regal

--

6. 3 Hannibal
