The protest is upheld and the amended relevant placings are:-

2nd - Valley Star (7)
3rd - Madeline Stowe (5)

Authorisation is given to payments of dividends and stakes based on the amended result.

Facts:

Following the running of Race 1, the “Monaro Mia Group 1 Runner Up Handicap Trot”, Information A9958 instigating a protest was filed by Chief Stipendiary Steward Mr N Ydgren alleging a breach of Rule 869A (2) by Junior Horseman Mr M Anderson. The Information stated "NOBLE MISTRESS shifted inwards into the passing lane when having an unimpeded run to the finish resulting in MADELINE STOWE being blocked for clear running”.

Rule 869A (2) states:- “When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with”.

The relevant judge’s placings were:-

1st - Alderbaran Bonny (1)
2nd - Noble Mistress (4)
3rd - Valley Star (7)
4th - Madeline Stowe (5)

The margins between the second and fourth horses were 1.25 lengths and a neck.

Submissions for Decision:

Stipendiary Steward Mr Renault using the head on film from the top of the straight identified Mr Anderson (Noble Mistress) in the trail behind Mr Cox (Deauville) with Mr Davis (Madeline Stowe) 3 back on the inside. He said Mr Anderson obtained a run to the inside of Mr Cox which meant he had an unobstructed run to the finish. Soon after the passing lane commenced Mr Renault said Mr Anderson allowed his horse to drift inwards into the passing lane thereby impeding Mr Davis who was entitled to a clear run.

Mr Davis said he had clear access as he started to move into the passing lane but then ran out of room. He added that at no stage from initially being impeded did he have full access to the lane through to the finish of the race.

Mr Anderson said he was the trailing horse and therefore not required to give the horse that was 3 back a run. He said the leader rolled out at the top of the straight before the passing lane which meant he became the lead horse, but he was not aware of Mr Davis to his inside. He said his horse had a boring pole on its inside and as it began to tire it severely lugged in.

Mr Thornley, who had assisted Mr Anderson in reviewing the film of the final stages of the race after the siren had been sounded but before the hearing commenced, had nothing to add.

In summing up Mr Ydgren quoted from Clause 6 the Passing Lane Regulations below:-

Clause 6 of the Passing Lanes, False Rails and Home Straight Regulations states:- “Subject to clause 4 hereof, in the last lap of any race no horse shall move inwards into the expanded inside lane (or any part thereof) when it has an unimpeded run to the finish line”.

(For completeness Clause 4 of the Passing Lanes, False Rails and Home Straight Regulations is also included below and states):- “In the last lap of any race the leading horse on the running line shall, upon entering the home straight, maintain as straight a course as possible parallel to the running line and allow the trailing horses full access to the expanded inside lane”.

Reasons for Decision:

The Committee has reviewed the films of the race from the top of the straight. At that point Mr Cox, who was leading the race, drifted out and began to weaken which meant that Mr Anderson, who was in the trail, became the lead horse and therefore had an obligation to maintain a straight line to the finish. When the Passing Lane commenced Mr Davis, who was trailing Mr Anderson, commenced to move into the lane and began to get established before Mr Anderson shifted down preventing Mr Davis from the full access he was entitled to. Whilst Mr Davis was not totally blocked he can be clearly seen having to restrain his horse which was full of running and then having to sit quiet all the way to finish because he did not have a clear run.

Taking all of the above into account the Committee believes that, had full access to the Passing Lane been available to “Madeline Stowe”, that horse would have finished ahead of “Noble Mistress” notwithstanding that the margins at the finish of the race between second and fourth were 1.25 lengths and a neck.
