Facts:

Following the running of Race 7 (Subway Marlborough Lines Stadium 2000 Hcp Trot Trot) Senior Stipendiary Steward Mr Mulcay lodged a protest (Information A11420) alleging that “Ideal Invasion” breached Rule 870(3) and the Breaking Horse Regulations by breaking for a distance in excess of 150m rounding the first bend. Ms O’Reilly, the driver of “Ideal Invasion” with the assistance of Open Horseman Mr De Filippi reviewed the film of the incident prior to the hearing and as a result stated on the Information that she did not contest the protest or wish to attend the hearing.

Submissions for Decision:

Mr Renault identified “Ideal Invasion” racing into the first bend approximately 120m after the start. He said at that point the horse broke and continued in a break for at least 170m before regaining its gait and continue in the race and finishing in 4th place.

Mr Mulcay said because the horse had broken for a distance in excess of 150m it was in breach of the above Rule and Regulations as a result of which he was seeking its disqualification from its finishing position of 4th.

Reasons for Decision:

The Committee has reviewed the film of the race going into the first bend and notes that “Ideal Invasion” broke from its gait after 120m and continued in a break for approximately 170m which was calculated by counting the number of marker pegs paced at 10m intervals passed by the horse during the time it was in a break. In doing so the horse has breached Rule 870(3) and the Breaking Horse Regulations.
