Facts:
Following the running of Race 1 (Crafar Crouch Construction Trot) Senior Stipendiary Steward Mr Mulcay lodged a protest (Information A11419) alleging that “Milly An Eyre” breached Rule 870(3) and the Breaking Horse Regulations by breaking for a distance in excess of 50m within the final 200m of the home straight. Ms Ottley, the driver of “Milly An Eyre” signed the Information stating she did not contest the protest and that she did not wish to attend the hearing.
Submissions for Decision:
Mr Renault identified “Milly An Eyre” racing just behind the leaders just prior to the 100m mark. He said at that point the horse broke and continued in a break until crossing the finish line and therefore had breached the above Rule and Regulations as a result of which he was seeking disqualification of the horse from it’s finishing position of 4th.
Reasons for Decision:
The Committee has reviewed the film of the final 150m of the race and notes that “Milly An Eyre” broke from its gait at approximately the 100m mark and continued in a break until crossing the finish line. In doing so the horse has breached Rule 870(3) and the Breaking Horse Regulations.
