Facts:
At about 10-25am a Request for a Ruling (Information 40230) was filed by Stipendiary Steward Mrs K. R. Williams seeking a ruling under the provisions of Rule 1102(2)(a)(ii) as to whether the race meeting should be abandoned.
The Information reads as follows.
“I the abovenamed informant hereby apply to the Judicial Committee and seek a ruling on the following matters:
Rule 1102(2)(a)(ii) – We request that the race meeting be abandoned due to weather and track conditions.”
Rule 1102(2)(a)(ii) reads as follows.
“(2) The functions of a Judicial Committee shall be:-
(a) from one hour prior to the advertised starting time of the first race of any day of a race meeting until after the conclusion of the last proceeding which it commences to deal with on that day, or thirty minutes after the last race run on that day (whichever is the later) to:-
(ii) determine any question as to whether that day of racing or any part thereof should be postponed, abandoned or cancelled….”
Submissions for Decision:
Mrs Williams gave evidence that prior to this race meeting commencing there had been concerns about the condition of the track caused by heavy rain and surface water. There had been an inspection of the track by Senior Horsemen Messrs A. M. Butt, J. R. Dunn and G. D. Smith who were all of the opinion that the track was unsuitable for racing because of water lying on the track. Officials of the racing club agreed with this assessment.
Reasons for Decision:
We were satisfied that the track was unsuitable for racing and that the race meeting should be abandoned.
