Following the running of Race 4 on the programme, an Information was lodged against trainer/driver Mr W Jennens, alleging a breach of Rule 869(2)(a)

Following the running of Race 4 on the programme, an Information was lodged against trainer/driver Mr W Jennens, alleging a breach of Rule 869(2)(a), in that he used his whip excessively in the run home when driving ARTFUL DANCER. Mr Jennens admitted the breach and elected not to be present.

Presenting his case, Stipendiary Steward Mr Ydgren, referred to the video of the race, which showed Mr Jennens (ARTFUL DANCER) striking that horse 23 times in the run home. He said that it may have looked worse with Mr Jennens' very obvious action and he was racing on the very extreme of the track, but it was excessive and did not help public perception at all.

To the Chairman he agreed the horse did not improve, was actually beaten at the time and finished well down the track.

In respect to penalty, Mr Ydgren said that Mr Jennens had not appeared previously, he was very remorseful, and he recommended a (small to moderate) fine.

In this case, driver Mr Jennens, appearing on a breach of Rule 869(2)(a), is charged with excessively using his whip on ARTFUL DANCER. He admitted the breach.

The committee agrees with the Stipendiary Steward that the use of the whip in this case did not look good. We note that the horse did not respond to the urgings and finished well down the track, and we agree 23-24 times in the run home is excessive.

Whilst the opportunity for the higher penalty is available, the committee in this case agrees with the penalty submissions of the Stipendiary Steward. Mr Jennens has not previously appeared, he does not drive very often, and was very remorseful and, I am sure, will benefit from being spoken to advisedly. In the circumstances, a fine of $150 will apply.
