Following the running of Race 2 on the programme, an information was lodged against driver Mr LF O?Reilly, alleging a breach of Rule 869(2)(a), in that he used his whip in an excessive manner

DECISION AND REASON

Following the running of Race 2 on the programme, an information was lodged against driver Mr LF O?Reilly, alleging a breach of Rule 869(2)(a), in that he used his whip in an excessive manner on ALTA ROMEO over the concluding stages of the race. Mr O?Reilly admitted the breach.

Presenting his case, Stipendiary Steward Mr Ydgren, referred to the video of the race, which showed Mr O?Reilly (ALTA ROMEO) in front of the field, but striking that horse 24 times in the run home and, whilst he finished a close second in the race, in his view this was excessive and outside the rules.

Regarding penalty, he said that Mr O?Reilly had not appeared before the Stipendiary Stewards and he recommended a (small to moderate) fine.

Mr O?Reilly, while admitting the breach, said it did not look good but otherwise did not wish to comment.

In this case, driver Mr O?Reilly appears on a breach of Rule 869(2)(a) in that he used his whip excessively on ALTA ROMEO over the concluding stages of the race. He confirmed he was familiar with the driver guidelines and has admitted the breach. He has an excellent record and has not previously appeared on a charge of this nature and, whilst he agrees it does not look good, he should be given some credit for that.

The penalty must be consistent with other recent cases and the submission from the Stipendiary Steward, in this case, is more than fair I would have thought. However, in the circumstances, and accepting those submissions, a fine of $150 will apply.
