Following the running of race 3, an Information was lodged against driver, Mr KV Hadfield, alleging a breach of Rule 869(2)(a), in that he used his whip excessively



Following the running of race 3, an Information was lodged against driver, Mr KV Hadfield, alleging a breach of Rule 869(2)(a), in that he used his whip excessively on De La Rosa in the run home, using it approximately 21 times. Mr Hadfield denied the breach.

Presenting her evidence, stipendiary steward Mrs Williams said that the stewards viewed Mr Hadfield use his whip approximately 21 times in the run home, which they consider excessive, and she referred to the published guidelines for drivers.

In considering this excessive use, Mrs Williams also said that Mr Hadfield used it 14-15 times in rapid succession over the final stages and she suggested alternative action, involving the use of the reins, for example. She referred to the video, and said that, although it was a closely fought finish, it did not give Mr Hadfield the right to breach the Rules to gain an advantage, and she particularly referred to the continuous action at the finish of the race.

Mr Hadfield, in his account, said he was only just beaten, and was gaining ground the whole way, and emphasised that it was only in the last 80metres that he was continuously hitting the horse. He said he was familiar with the guidelines but that, had he sat up, he would have been in the room for not driving the horse out.

Mr Hadfield appears following race 3 on a breach of Rule 869(2)(a) in that he used his whip excessively on De La Rosa in the run home, using it approximately 21 times.

Excessive clearly means ‘too much’, and this committee has to determine if the use of the whip was excessive. Harness Racing New Zealand has provided guidelines determining the use of the whip and Mr Hadfield indicated he is familiar with these.

In this case, having heard the evidence and viewed the video, and acknowledging the close finish, I am satisfied the use of the whip was excessive. I accept that there was a break in its use early in the straight but, combined with this, I find Mr Hadfield’s admission of using the whip 14-15 times in succession in the last 80metres or so, continuously, is excessive. Had there been a break in that time, it may well not have come to an Information but, in accepting the submissions of the stipendiary stewards, I find the charged proved.

In respect to penalty, Mr Hadfield, through endorsing the Information, asked the committee to have regard to this being his first breach. Mrs Williams recommended a monetary penalty in the order of $200.00 which is consistent with a first offence. To Mr Hadfield, she said it was standard to recommend a fine in the first instance, with a possible suspension for a second breach.

Following submissions, I am satisfied the recommendation from the stipendiary stewards is appropriate in this case and, being a first such breach, a fine of $200.00 will apply.
