Following the running of race 1, the Three Bears Tearooms Trot, a protest was lodged by the stipendiary stewards against horse number 6, HARRY JOHNSON (M P Jones), placed 4th by the judge, on the grounds that it broke from its gait in the run home, and failed to promptly regain its gait.

The placings were : 9 – 2 – 1 – 6 – 4 – 12.  When the hearing commenced, the Committee was advised that Ms A Edmonds, representing the stable and the connections, did not contest the protest.  The Information was so endorsed.

Chief Stipendiary Steward Mr Escott explained the circumstances and invited Stipendiary Steward Mr McIntyre to highlight the breach on the video of the race.  He showed that in the run home HARRY JOHNSON moved down to the inside running and then went into a break.  It continued in a gallop for about 90 metres to the finish line and, in so doing, was in breach of Rule 870 (3) and the Breaking Horse Regulations.

DECISION
This protest was not contested, and was lodged by the stipendiary stewards against horse no. 6, HARRY JOHNSON (M P Jones), placed 4th by the judge.

As described by the stewards and as evidenced by the video, we find that HARRY JOHNSON, driven by Mr Jones, broke in the run home and continued in a break for about 90 metres and that, in galloping in excess of 50 metres and failing to promptly regain his gait, HARRY JOHNSON was in breach of Rule 870 (3).  Accordingly the protest is upheld and, following submissions, we exercise our discretion to disqualify HARRY JOHNSON from the race.
