Decision:

Following the running of Race 5, the Braddick Construction Discretionary Handicap Trot, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr D. N. Jones, licensed trainer of  SO AND SO (9), alleging a breach of Rule 849(2).  It was alleged that the Mr Jones presented SO AND SO and failed to correctly attach the proper numbered saddlecloth to both sides of the saddle.

Following the running of Race 5, the Braddick Construction Discretionary Handicap Trot, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr D. N. Jones, licensed trainer of  SO AND SO (9), alleging a breach of Rule 849(2).  It was alleged that the Mr Jones presented SO AND SO and failed to correctly attach the proper numbered saddlecloth to both sides of the saddle.

Mr Jones had indicated on the information that this breach was admitted, and he confirmed this at the hearing.  He also agreed that he understood the charge and the Rule it was brought under.

Mr Renault gave evidence that the horse was number “9” in the race, and that when the horses were in the parade ring Stipendiary Steward Mr McIntyre could see that it was wearing the correct number.  However Mr McIntyre could only see one side of the horse, and when it was on the track it was noticed that it had number “6” on its other side, with the number “9” saddle cloth having been affixed upside down.  The matter was corrected before the start of the race.

Mr Jones said he accepted full responsibility for this error, and that he was usually very careful when affixing gear and saddle cloths.

Penalty:
         
In relation to penalty Mr Renault advised that Mr Jones had no relevant previous convictions, and as he had admitted the breach a fine of $150-00 was  recommended.

After considering the matter of penalty, and after looking at previous fines for breaches of this Rule, we were satisfied that $150-00 was an appropriate fine in these circumstances.  The parties were therefore advised that Mr Jones was fined the sum of $150-00.
