Decision:
Following the running of Race 8, the Gas Renwick Mobile Pace, an information was filed by Stipendiary Steward Mr S. P. Renault against Ms J. L. Williams, driver of KONNI KASE (13), alleging a breach of Rule 869(3)(b) and the “Easing Down” Regulations. The charge was that Ms Williams drove carelessly when attempting to hold her position on the inside of CAUGHTINTHECROSSFIRE (5) (T.S. Chmiel), when she was being legitimately eased down from the two wide line.

Following the running of Race 8, the Gas Renwick Mobile Pace, an information was filed by Stipendiary Steward Mr S. P. Renault against Ms J. L. The charge was that Ms Williams drove carelessly when attempting to hold her position on the inside of CAUGHTINTHECROSSFIRE (5) (T.S. Chmiel), when she was being legitimately eased down from the two wide line.
--Ms Williams had indicated on the information that she admitted this breach of the Rules and that she did not wish to attend the hearing.
--Mr Renault gave evidence and used video coverage to show that at about the 2000 metre mark Ms Williams was in the two out line and on the inside of Mr Chmiel (CAUGHTINTHECROSSFIRE), who attempted to “ease her down” on to the marker line in accordance with the “Easing Down” Regulations. Ms Williams resisted this manoeuvre and as a result her horse went into a break.
--In explanation Ms Williams said that she was unaware of the requirements of the “Easing Down” Regulations.
--Penalty:
--In relation to penalty Mr Renault advised that Ms Williams had not previously breached this Rule. She had advised the Stipendiary Stewards that she was not in a position to pay a fine, and would prefer a suspension. In the circumstances Mr Renault recommended a two day suspension.
--In considering the matter of penalty we were satisfied that two race days was appropriate. Ms Williams was therefore suspended from after the completion of racing today (14 June 2009) until after the completion of racing on 23 June 2009, which is a two day suspension.
