Facts:
Following the running of Race 5, the Speights Discretionary Handicap Trot, an Information was filed by Stipendiary Steward Mr S. P. Renault against Open Horseman Mr M. P. Edmonds alleging a breach of Rule 869(2)(c) in that he used his whip outside the confines in the run home.
The charge reads as follows:
“I the above named informant allege that the above named Respondent committed a breach of Rule 869(2)(c) in that you used your whip outside the confines when driving (The Truth) in the run home.”
Rule 869(2)(c) reads as follows:
“(2) No horseman shall during any race:-
(c) project his whip outside the sulky or draw his whip further back than the sulky seat.”
Submissions for Decision:
Mr Edmonds had indicated on the information that this breach of the Rules was admitted, and we were advised by Mr Renault that he did not wish to attend the hearing.
Mr Renault gave evidence and used video coverage to show that Mr Edmonds had used his whip on about nine occasions well outside the confines of the sulky in the run home.
Reasons for Decision:
As Mr Edmonds had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Submissions for Penalty:
In relation to penalty Mr Renault advised that Mr Edmonds had not previously breached this Rule, and had admitted the breach. Mr Renault advised that the Penalty Guide recommends a fine of $200-00 as a starting point for a breach of this Rule, and submitted that a fine of $200-00 should be imposed in this case.
We adjourned to consider the question of penalty.

We took into account that Mr Edmonds had admitted this breach, and had not breached this Rule previously. On the other hand this was a blatant breach involving about nine strikes with the whip. We looked at the Penalty Guide and penalties imposed for past similar breaches of this Rule and decided that a fine of $200-00 should be imposed in this case.
