An information filed by Stipendiary Steward Mr J Muirhead against Mr I Brownlee driver of WHODATDARE, alleging a breach of Rule 869 (2) (a) – excessive use of the whip – in that he used his whip excessively when driving out his horse over the concluding stages.

Mr Brownlee admitted the breach and was present at the hearing.

Mr Muirhead demonstrated the breach by use of the video film.  He said Mr Brownlee use the whip on his horse about 30 times during the last 500m of the race.  He said although there were pauses involved, the number of times was excessive.

Mr Brownlee accepted Mr Muirhead’s summary of the breach and said that he needed to clean his act up.

Mr Muirhead said Mr Brownlee had no relevant breaches of the rules recorded against him.  He said Mr Brownlee had told him he preferred a suspension rather than a fine.  Mr Muirhead recommended a two day suspension.  Mr Brownlee accepted the recommendation.  In fixing penalty I take into account the following :

1.            The guilty plea.

--

2.            Mr Brownlee’s clear driving record.

--

3.            The submissions of Mr Muirhead.

--

4.            The acceptance of those submissions by Mr Brownlee.

--

5.            The offending was midrange on the scale of seriousness.

--

6.            The recommended starting point is a fine of $250.00 or a one week suspension.

Balancing those matters I suspend Mr Brownlee’s horseman’s licence until the conclusion of racing on the 7th of November 2008.  This is one week, and effectively two days suspension.
