An information filed by Stipendiary Steward Mr T Taumanu against Junior Driver Ms K Blakemore, driver of JUPITER FRANCO, alleging a breach of Rule 869 (3) (b) – Careless Driving – in that she drove carelessly when shifting her horse outwards with 500m to run, causing interference to several other runners.

--Ms Blakemore admitted the breach and was assisted at the hearing by Senior Horseman Mr J Stormont.
--The facts of this matter were as produced at the associated protest hearing.
--PENALTY
--Mr Taumanu said he was concerned that there had been a disqualification and other runners had lost their chances. He said Ms Blakemore had a clear driving record. He suggested a three day suspension. Ms Blakemore said she would prefer a suspension rather than a fine. Mr Stormont said he thought considerable blame rested with the horse EASTWOOD SAPPHIRE.
--In fixing penalty I take into account the following matters :
--1. The guilty plea.
--2 Ms Blakemore’s clear record.
--3. The submissions of Mr Taumanu.
--4. The submissions of Ms Blakemore and Mr Stormont.
--5. The mitigating factor that the horse in front of JUPITER FRANCO broke, resulting in her moving her horse outwards.
--6. Ms Blakemore is a junior driver – has had only nine drives – and it was probably a natural instinct for her to do what she did. The offending therefore is mid-range on the scale of seriousness – there was a disqualification.
--7. The recommended starting point for penalty is a fine of $400.00 and/or a suspension of two weeks.

Balancing those matters, I suspend Ms Blakemore’s horseperson’s licence up to and including the 7th of October 2008, which is effectively three days.
