An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr M McKendry, driver of CHRISTIAN SPIRIT, alleging a breach of the above rule ? careless driving

An information lodged byStipendiary Steward Mr J Muirhead, against Mr M McKendry, driver of CHRISTIAN SPIRIT alleging a breach of the above rule - careless driving - in that he drove his horse carelessly causing interference to BOSS NEW YORK, driven by P Jeffries, with approximately 150m to run.   Mr McKendry admitted the breach and was present at the hearing.  Mr Muirhead outlined the circumstances of the offending as already described in the associated protest hearing.   Mr McKendry said he believed the racing manners of BOSS NEW YORK contributed to the incident.

Penalty:

Mr Muirhead suggested a fine in the vicinity of $500 or a suspension.  He said Mr McKendry was suspended for two days on the 1st March 2005 on a charge of careless driving.  He said the driving was not as serious as it could be, not the worst he had ever seen, but that Mr McKendry took a risk and the result was his horse was relegated.  Mr McKendry said driving was his sole income and that the other horse contributed to the incident.  In imposing penalty the committee took into account the following matters -

3.  Mr McKendry's driving record

--

4.  That the offending was in the mid to lower range on the scale of seriousness.

5.  The penalty imposed on driver, Mr J Stormont, earlier this year on a charge of careless driving - $400 - the circumstances being similar to this matter and where Mr Stormont had not admitted the breach.

6.  The guilty plea

--

Balancing all of those matters, the committee imposed a fine of $350.
