Facts:

Following the running of Race 8 THE ALEX BAR & EATERY MOBILE PACE, an Information was lodged by Stipendiary Steward, Mr JM Muirhead against Licensed Amateur Horseman, Mr D Blakemore alleging that Mr Blakemore drove KILARNEY GUY carelessly striking the sulky wheel of EASY FOR CULLEN with 2100 metres to run.

Mr Blakemore was present and advised me that he admitted the breach.

Mr Muirhead demonstrated the incident by use of the Race films. He showed where Mr Blakemore had moved his horse and it just touched the sulky wheel of EASY FOR CULLEN and punctured that horse's tyre.

Mr Blakemore agreed with the facts.

Submissions for Penalty:

Mr Muirhead said that it was only a slight touch of the sulky wheel but it was sufficient to puncture the tyre of EASY FOR CULLEN and affect that horse's chances. He said that Mr Blakemore had readily admitted the breach and had been vey co-operative with the Stewards.

Mr Muirhead referred to the JCA Guidelines and said that as this was not a major incident the appropriate penalty should be that prescribed for a breach of Rule 869(4) which is a fine of $200.00

Mr Blakemore accepted that a fine of that amount was appropriate.

Reasons for Penalty:

I agree that this was only minor negligence because Mr Blakemore's horse only just touched the sulky wheel of EASY FOR CULLEN but it did puncture the tyre and affected that horse's chances.

Mr Blakemore is given credit for admitting the breach and for his co-operation not only with the Stewards but also at this hearing.

The level of fine submitted by Mr Muirhead is in my view appropriate.
