Facts:
Following the running of Race 2 the CARREL ELECTRADE HANDICAP TROT an Information Instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 4th placing of CREAMEE (Driver John Dickie) on the grounds of breaking with 250 metres to run and galloping for the last 250 metres and therefore failing to regain its gait promptly.
Co-Trainer Mr Joshua Dickie endorsed the Information with the words " I do not contest the Protest ".
Mr Muirhead demonstrated the incident by use of the Race films and these clearly showed CREAMEE breaking and then galloping for the last 250 metres.
Submissions for Decision:
Mr Muirhead submitted that as CREAMEE had galloped in excess of 50 metres in the last 200 metres it was in breach of the Breaking Horse Regulations and therefore should be disqualified from the Race.
Reasons for Decision:
The Protest is not contested. The Race films clearly show CREAMEE breaking and then galloping in excess of 50 metres in the last 200 metres and therefore it is clearly in breach of the Breaking Horse Regulations.
