Following the running of race 2 an information alleging a breach of rule 869 (2) (a) was filed the informant was Mr J.M.Muirhead and the defendant Mr L Hollis. The information stated that Mr Hollis had used his whip excessively

Following the running of race 2 an information alleging a breach of rule 869 (2) (a) was filed the informant was Mr J.M.Muirhead and the defendant Mr L Hollis. The information stated that Mr Hollis had used his whip excessively on his horse IZSHEFAKING over the concluding stages of the race.

Mr Hollis did not admit the breach of this rule and was present at the hearing.

Mr Muirhead opened his case by showing the video of the run home and this showed Mr Hollis driving IZSHEFAKING come around the turn and under a drive from the straight entrance to the winning post it was alleged by Mr Muirhead that Mr Hollis had struck his horse with the whip at least 25 times from the turn to the finishing post with no pauses. Mr Muirhead stated that this was in breach of rule 869 (2) (a) and also in breach of the guidelines which have been well published in the Harness Racing Weekly and endorsed by the Horsemans Association.

The chairman asked Mr Hollis if he was aware of the guidelines and Mr Hollis stated he was well aware of them.

Mr Hollis when giving his evidence stated that the mare he was driving was lazy and if he had not used the whip on her in the manner he did she may well have not finished 2nd , Mr Hollis said his owners were happy with his drive.

When questioned by the chairman if having now viewed the video Mr Hollis was in breach of the rule and guidelines as to the use of the whip Mr Hollis stated he now considered that he was in breach of this rule.

Mr Hollis was asked by the chairman if he wished to change his plea and admit the breach of this rule. Mr Hollis then signed the information and admitted the breach of this rule.

Submissions on penalty were heard from both Mr Muirhead and Mr Hollis. Mr Muirhead stated that Mr Hollis had a very good record and requested a fine in this instance as this was Mr Hollis's first breach of this rule for a number of years. Mr Hollis stated he was prepared to pay a fine.

Decision and Reasons.

Having taken into consideration the admission of the breach of this rule by Mr Hollis and also his very good driving record a fine of $250.00 was imposed in this instance .

Mr Hollis was also advised by the chairman that a repetition of excessive whip use would ultimately lead to a suspension of his horseman's licence.
