As Mr Grylls admitted the breach, it is proved.

Penalty:

Mr Grylls’ licence is suspended from the close of racing Saturday 17 April 2021 up to and including Thursday 22 April 2021. In addition, Mr Grylls is fined the sum of $250.

Facts:

Following the running of Race 6 an Information was lodged by Mr Goodwin alleging a breach of r 638(1)(d) in that Mr Grylls (AWESOME AL) angled his mount out near the 800 metres forcing MOZZIE (Ms L Hemi) over extra ground.

Video evidence was provided outlining the incident. Approaching the 800 metre mark Mr Grylls was positioned against the fence approximately two lengths behind the leading horse, MISS SHER NAN (Mr Bradley). MOZZIE was positioned to his outside.

In an effort to improve his position Mr Grylls angled his horse off the fence. This movement had the effect of hampering the line of MOZZIE and forcing this horse over extra ground. Ms Hemi unsuccessfully endeavoured to keep Mr Grylls in, as she was entitled to do under the Rules. Mr Goodwin noted that in his view not a lot of ground was lost as a result of the incident.

When asked to comment, Mr Grylls stated that he initially thought the gap was there, and that MOZZIE was further back. When asked whether his movement was as a result of the leading horse having been eased, he replied in the negative. He said he thought he saw an opportunity to get out. It was a split second gap and was a chance to get off the fence. He accepted he had pushed Ms Hemi out for too long.

Submissions for Penalty:

Mr Grylls' riding record was outlined. He was last suspended on 2 October 2020. Mr Goodwin said that in the context of Mr Grylls’ workload, his recent record was to be commended.

Mr Goodwin described the breach as low range. His comment that Mr Grylls' actions “just crossed the line” was noted. The Committee concurs.

Mr Grylls asked for a deferment of his penalty until after 17 April. The Stewards did not object to this.

Reasons for Penalty:

The breach is low-range. Mr Grylls has pushed Ms Hemi out for 2 or 3 strides too long. While she was buffeted and briefly forced outwards, she did not lose a great deal of ground as a result of the breach. The NZTR revised Penalty Guidelines for careless riding provide a 4-day suspension and a $250 fine as starting point for a low-range careless riding charge.

In setting penalty, mitigating factors are Mr Grylls’ excellent recent riding record and his admission of the breach. His penalty is reduced by 1 day to 3 days from our 4-day starting point.
