Decision:

Following the running of Race 6, The Oaks Stud Manawatu Classic(Group 3) Mr C.Ormsby was charged with careless riding under rule 871 (1) (d). The information alleged C.Ormsby the rider of SheikMahaand allowed his mount to shift inward in the home straight when not clear of NoCash

Following the running of Race 6, The Oaks Stud Manawatu Classic(Group 3) Mr C.Ormsby was charged with careless riding under rule 871 (1) (d). The information alleged C.Ormsby the rider of SheikMahaand allowed his mount to shift inward in the home straight when not clear of NoCash (K.Myers)and Bunker Blues (V.Colgan) causing those runners to check.

Mr Ormsby admitted the breach and was represented by Mr Andrew Carston.

Mr. Goodwin demonstrated the incident by way of two video films. It showed Mr Ormsby riding approximately six horse widths off the fence with Kelly Myers on his immediate inside and Vinny Colgan beside her. Mr Ormsby while riding with vigour allowed his mount to shift in causing tightening to Ms Myers who in turn moved in on Mr Colgan. Mr Goodwin estimated that Mr Ormsby had moved in four horse widths from his original position.

Penalty Decision

Mr George produced Mr Ormsby's riding record. Since the 24^th August 2006 he has been charged four times under this particular rule. Mr.George said that he had caused severe interference to the runners on his inside and recommended a suspension as well as a monetary penalty to act as a deterrent to careless riding of this nature.

Mr Ormsby asked the committee to take into account that his mount had moved in quite suddenly and taken him somewhat by surprise. He had made an attempt to straighten up but was too late. He also told the committee that he rides in both the North and South Islands.

The committee took into account all of the submissions including the fact that Mr Ormsby admitted the breach.

In coming to a decision on penalty we had regard to the status of the race (Group 3), the stakes payable of the race and the fact that two other runners were severely hampered by the interference Mr Ormsby caused.

The committee considered Mr Ormsby to have an unenviable riding record and that a suspension and monetary penalty should be imposed.

Mr Ormsby is suspended from riding from the close of racing on Wednesday April 4^th until the close of racing on Saturday April 14^th. In addition we impose a monetary penalty of $1000.00.
