Decision:

Following the running of Race 10, The Hotel Coachman Premier over 2100 meters, Mr. N. Harris was charged with careless riding under rule 871 (1) (d). The information alleged he permitted his mount to shift inwards taking DUTYFUL (C.Grylls) inwards tightening the running of FIORANO (O Bosson), AINTREE (L. Allpress), COLOMBIAN STRIKE (J.McDonald). As a result FIORANO and AINTREE had to be checked near the 150 meters.

Following the running of Race 10, The Hotel Coachman Premier over 2100 meters, Mr. N. Harris was charged with careless riding under rule 871 (1) (d). As a result FIORANO and AINTREE had to be checked near the 150 meters.

Mr. Harris admitted the breach of the rule.

Mr. Goodwin (Stipendiary Steward) identified the horses and riders involved and demonstrated the incident on the available films.  Mr. Harris was wide out on the track heading for home when he allowed his mount to move inwards four to five horse widths with resultant tightening to horses on his inside. He had the opportunity to straighten but moved inwards when riding with vigour.

Mr. Harris said that he did try to straighten Golan Star but she moved in more than he expected after being hit once with the whip.

Mr. Sanders produced Mr. Harris’s riding record for the last twelve months which showed the following careless riding charges:
26/04/08 Cambridge 4 days
07/02/09 Waikato   5 days

The Stewards while conceding that Mr. Harris had attempted to straighten his mount submitted that a suspension of four to five days was appropriate.

Mr. Harris said that he rides in the Central and Northern Districts only and has no firm commitments within the next seven days.

Penalty

In coming to a decision on penalty the committee carefully considered all of the submissions put before it.
We have taken into account Mr. Harris’s admittance of the breach, his good riding record and his attempt to correct Golan Star’s inward movement however four horses had their chances affected as a result of his careless riding.
In setting a period of suspension we had regard to Mr. Harris riding predominantly in the Central and Northern areas.
He is suspended from the close of racing today, Saturday March 28th 2009 until the close of racing on Wednesday April 8th 2009 – in effect five days.
