As Mr Bishop admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Mr Bishop’s license is suspended from the close of racing on Tuesday, December 29, 2020 up to and including racing on Monday, January 4, 2021 (5 days). In addition, he is fined the sum of $500.

NB: (Riders had been declared through until 29/12/20).

Facts:

Following the running of Race 9, an Information was lodged by Mr Goodwin alleging a breach of Rule 638(1)(d) in that R Bishop (SANIBEL) allowed his mount to shift out near the 150metres when not clear of POWER “N” PASSION which was checked.

Mr Goodwin used the three available video angles to explain the incident. Both Mr Bishop and Mr Mudhoo were racing in the middle of the field looking for room to come through. Mr Mudhoo was behind Mr Bishop when a gap presented towards the outside. Both riders angled out for the same run but in doing so Mr Bishop took the line of Mr Mudhoo and caused him to check and blunder.

Mr Bishop admitted the breach but explained to the Committee that both he and Mr Mudhoo angled out at the same time. It was his opinion that the run was his as he was in front, and Mr Mudhoo’s inexperience contributed to the incident.

Submissions for Penalty:

Mr Goodwin presented Mr Bishop’s riding record which showed 2 breaches of the careless riding Rule within the last 12 months:
19/9/20 - 5 days suspension
31/7/20 - 3 days suspension

Mr Goodwin described today’s breach as midrange and submitted that a penalty in line with the updated guidelines was appropriate.

Mr Bishop concurred with Mr Goodwin’s assessment of the breach as being midrange.

In response to questions from the Committee Mr Bishop said he had no riding commitments within the next 10 days.

Reasons for Penalty:

The Committee considered all submissions. Mr Bishop was not aware that Mr Mudhoo, who was in behind him, was angling for the same run through to their outside. At the time he believed the run was his but unfortunately, he cut in front of POWER “N” PASSION when not the required distance clear. There was no intent from Mr Bishop to cause interference, but Mr Mudhoo was entitled to be where he was, and as a result his mount blundered badly at a critical time of the race. For these reasons we placed the incident in the midrange.

In setting penalty, the Committee adopted the starting point from the revised penalty guidelines for careless riding which came into effect on December 9, 2020.

Low range:- $250 + 4 day suspension
Mid-range:- $500 + 5 day suspension
High range:- 9 day suspension

The Committee took into account all submissions including Mr Bishop’s record which we considered a neutral factor.

There were no aggravating factors requiring an uplift from the midrange starting point.
