Accordingly the protest was dismissed and placing confirmed as:
1st - (9) ASTRID
2nd - (3) OPULENT
3rd - (1) WILLS ROAD

The committee authorised the payment of dividends and stakes in accordance with its decision. 

Facts:

Following the running of Race 7 (The Speight's Ale House Handicap 1400m) Information A3518 was filed with the judicial committee. It instigated a protest under the provision of Rule 642(1) alleging that ASTRID placed first by the judge interfered with the chances of WILLS ROAD placed third by the judge. It alleged interference in the home straight.

The provisional placings were:
1st - (9) ASTRID
2nd - (3) OPULENT
3rd - (1) WILLS ROAD
4th - (5) SHADOW FOX
5th - (7) GOLDEN BAY
6th - (10) MISS DAISY

The margin between first and second was a nose, with a long neck to third. 

Submissions for Decision:

Co-Chief Stipendiary Steward Mr Neal identified ASTRID and WILLS ROAD on the head-on film as they approached the 200 metres. During the course of the hearing, the rear-view and side-on angles were also played.

Mr Lynds used the head-on film to indicate that there had been outwards movement from SHADOW FOX, which was in the lead approaching the 200 metres. He also observed further outward movement from the 200 metres from the eventual winner ASTRID, onto his runner WILLS ROAD. He submitted that ASTRID continued to move outwards onto his horse which meant WILLS ROAD was unable to be ridden out fully and had affected its ability to win the race. He believed the inability for Miss Myers to ride WILLS ROAD out to the extent that it should have been and the close margin were compelling factors.

Miss Myers stated that she had obtained a marginal run as a result of MISS DAISY weakening. She then felt ASTRID pushing from her inside against her mount from the 200m as Mr Turner sought to take the gap that had been presented as well. She believed her horse was very uncomfortable and she had attempted to pull her horse off that of Mr Turner's in order to give WILLS ROAD clear air and a fair chance. She identified ASTRID coming from the three wide to the ten wide and that she had received pressure from the 200 metres mark. She believed the interference was sufficient as her horse had been unable to relax and get to the line.

Mr Turner used the head-on film to identify Miss Myers trying to push out, while SHADOW FOX (J Parkes) rolled in half a width, presenting a gap for Mr Turner to take. He then believed Mr Parkes then moved outwards; with Mr Turner describing the movement of SHADOW FOX from a one-off to a seven-off position, and as a result ASTRID had continued to be affected by SHADOW FOX laying out.

Ms Gerrard submitted that soon after turning for home, Miss Myers had gone for a run presented as a result of MISS DAISY weakening. As a result of this, she had moved in on to ASTRID. SHADOW FOX had also moved outwards, requiring Mr Turner to move to the outside. She also believed Miss Myers had then moved inwards on to ASTRID, and that Mr Turner had ridden his horse hand and heels, while Miss Myers had continued to use the whip on her horse over the concluding stages.

Co-Chief Stipendiary Steward Mr Neal was invited to make submissions on the incident, but not to comment on the merits of the protest. In doing so, he submitted that heading for home WILLS ROAD obtained a run to the inside of MISS DAISY when that runner weakened. At that point, he believed ASTRID had still been held up. He used the head-on film to identify some minor inwards movement from WILLS ROAD and that contact with ASTRID had been made. The consequence of that contact was that ASTRID moved outwards and bumped with WILLS ROAD for some distance before easing off. SHADOW FOX then moved out under pressure, taking ASTRID out onto WILLS ROAD. He submitted that as a result, both those runners were taken wider, with ASTRID continuing to inconvenience WILLS ROAD. The side-on film identified WILLS ROAD to be in front of ASTRID by approximately a neck, with ASTRID obtaining clear running late in the piece and going to the line strongly. 

Reasons for Decision:

It was clear that approaching the 200 metres, MISS DAISY was weakening and as a result a gap was presented that WILLS ROAD sought to take. In doing so, WILLS ROAD had moved inwards applying some pressure to ASTRID. The committee found the head-on and rear-view films helpful in confirming this. We also observed SHADOW FOX to move outwards from a three-off position to one of four-off the running rail. This movement sent both ASTRID and WILLS ROAD wider on the track. While there was some inconvenience to Miss Myers, she was still able to ride her mount out to the line. When reviewing the run to the line, the head-on and side-on films supported the view that the winner was holding its own and the committee was not satisfied that had the interference not occurred, WILLS ROAD would have beaten ASTRID.
