 As the charge was admitted, the Committee found the charge proved.

Penalty:

Miss Dravitski's licence to ride is suspended from the close of racing on Thursday 1 January up to and including racing on Thursday 15 January. The suspension incorporates the Wairarapa (2nd), Woodville (3rd), Otaki (5th), Marton (10th), Egmont (11th) and Wanganui (15th) meetings. 

Facts:

Following the running of Race 4 (92.2 More. FM Maiden 1600m) Information A390 was filed with the Judicial Committee. It alleged that "Apprentice rider M Dravitski (SUSPECT) allowed her mount to shift outwards near the 200 metres into the line of BABY GEE which clipped that runners heel and blundered".

Miss Dravitski, assisted by Mr K Gray, confirmed that she understood the rule and that she admitted the breach.

Using the head-on, side-on and turn cameras, Mr Goodwin identified SUSPECT (M Dravitski) and BABY GEE (J Shackleton) racing near the 200m, where Miss Dravitski allowed her mount to run out into the line of BABY GEE, which then clipped heels and blundered. Mr Goodwin pointed out that at no stage was she clear when she angled her mount out into clear running in search of a run. Miss Dravitski said she believed at the time she was half clear, but it was subsequently apparent that she was not. Mr Gray stated there was nothing much to say except that it was clear it was a bad ride and a complete lack of judgement on Miss Dravitski's part.

Submissions for Penalty:

In presenting Miss Dravitski's record, Mr Neal acknowledged that she had a clear record for the previous 12 months. He believed the consequence to Miss Shackleton was that she was severely interfered with. The stipendiary stewards believed that whilst this was out of character for Miss Dravitski, the level of carelessness sat within the mid to high range and submitted a period of suspension was appropriate.

Miss Dravitski submitted that she had a very good record and asked the committee to take that into account. She advised she had engagements at Hawkes Bay on 1 January, and rode primarily in the Central Districts area. Mr Gray believed Miss Dravitski's record was excellent for someone who rides very frequently.  

Reasons for Penalty:

The Committee considered all of the submissions placed before it and believed a period of suspension was appropriate, adopting a five day starting point. The Committee independently assessed the level of carelessness to be at the lower end of the high range. It occurred at a vital stage of the race, and Miss Dravitski angled her mount out sharply when she was not sufficiently clear. Miss Shackleton was entitled to be where she was, and the carelessness resulted in two consequences. Firstly, Miss Shackleton's rightful line had been taken and secondly her horse had clipped a heel and blundered as a result. The Committee considered this to be an aggravating factor. In mitigation the Committee considered her very good riding record within the last 12 months for someone who is a busy rider, and her early admission of the breach. On balance, the Committee considered that a six day period of suspension was appropriate.
