As the charge was admitted the charge was found to be proved.
Penalty:
Accordingly we imposed a fine of $150.
Charge:
Following Race 6, an information was lodged by the Stewards alleging a breach of Rule 638(3) (b) in that S Spratt the rider of SLIPPERY MISTAKE used her whip excessively prior to the 200m.
Facts:
Mr Goodwin showed the films of the stage of the race where the breach occurred. Prior to the 200m Ms Spratt used her whip excessively when she was seen to hit her horse five times, stop for two strides, then go on to hit it again nine more times. She was outside the accepted guidelines of using the whip six times then stopping for six strides before using it again.
Submissions for Penalty:
Mr Neal informed the committee that Ms Spratt’s record showed no breaches of this rule this year. He said a recent case where a rider had hit their horse 12-16 times without respite had incurred a fine of $200. He said Ms Spratt’s breach today was well below that level.
Ms Spratt had no submissions to make on penalty.
Reasons for Penalty:
The guidelines for whip use in New Zealand are well recognised and understood by riders. Ms Spratt has breached those guidelines today but taking into account the number of strikes and the manner in which they were delivered the committee placed the breach towards the lower end. We also considered other recent penalties and Ms Spratt’s early admission of the breach.
