Mr Finnegan appeared before the committee today in relation to an alleged breach of Rule 1002(1)(b) at the Manawatu meeting on Saturday last (22nd Dec).
Mr Finnegan appeared before the committee today in relation to an alleged breach of Rule 1002(1)(b) at the Manawatu meeting on Saturday last (22nd Dec).
--It was alleged that Mr Finnegan failed to attend a steward’s enquiry after being directed to do so.
----Mr Finnegan admitted the breach.
--Prior to receiving submissions on penalty the committee were provided with the circumstances that led to Mr Finnegan being charged.
--These in essence were that both Mr Goodwin and Mr Ray had requested Mr Finnegan to appear at a hearing regarding the non-declaration of a rider for his horse KITTY O’HARA, an acceptor in race 10 on Saturday’s card.
--At no time when speaking with either Mr Goodwin or Mr Ray did Mr Finnegan advise that he would have difficulty attending.
--Mr Finnegan, when addressing the committee, stated that as his horse was in race 10 and as he was attending to post race formalities including washing the horse and cooling it down, and he had simply run out of time to attend.
--He also had issues with the transportation of the horse back to his training establishment.
--He however acknowledged that he had not contacted the stewards and told them of his position.

PENALTY
--When making his submission Mr Goodwin stated that the breach should be dealt with by way of a moderate fine.
--Mr Finnegan submitted that he did not think this should be excessive.
--After considering all factors the committee find that the matter should be dealt with by way of a fine, and with regard to quantum we find that this should be $200.
--In reaching this determination we are mindful that Mr Finnegan had a clear duty to comply with the request made of him and he has not done so.
--Nevertheless Mr Finnegan has been under some pressure and there were factors that mitigated the penalty.
