As Mr Yanagida admitted the breach, it was deemed to be proved.

Accordingly, Mr Yanagida’s license is suspended from the close of racing today, December 19th up to and including racing on Friday January 1st. In addition he is fined the sum of $500.
Facts:
Following the running of Race 4 (The Tank Guys 2100), an Information was lodged by Mr Oatham alleging a breach of Rule 638 (1) (d) in that Taiki Yanagida (SATRIANI) allowed his mount to shift out near the 300m when not clear of BEAU GESTE (Sam O’Malley) which was checked.
Mr Oatham had Mr Goodwin explain the incident using all three video angles. The head-on video showed a gap present for Mr Yanagida around the 300m mark. He angled out to take the run but in doing so moved into the line of BEAU GESTE forcing rider Mr O’Malley to check.
The rear view showed Mr Yanagida riding with vigour, and highlighted the amount of ground he moved out, and the side-on view clearly showed that he was never the required distance clear of Mr O’Malley when he made his run.
Mr Yanagida conceded that he had ridden carelessly. Ms Gerrard told the Committee that Mr Yanagida had not ridden at this track very often and thought maybe the camber had caused him to “lose his way” around the corner.
Submissions for Penalty:
Mr Oatham presented Mr Yanagida’s riding record which showed 3 breaches of the careless riding rule within the last 12 months:
27/2/20-Counties-8 days suspension
29/2/20-Auckland-7 days suspension
28/11/20-Auckland-6 days suspension
Mr Oatham described today’s breach as just above midrange and submitted that a penalty in line with the updated guidelines was appropriate.
Mr Yanagida and Ms Gerrard were allowed time to talk to Mr Yanagida’s racing manager in order to ascertain any upcoming riding commitments.
Reasons for Penalty:
The Committee considered all submissions. Mr Yanagida was, at the most, half a length clear when he came across into the line of BEAU GESTE. The rear-view film showed that at no stage did Mr Yanagida attempt to correct his line of running despite causing a relatively severe check to that runner. Mr O’Malley was forced to stand up in order to avoid heels and was fortunate not to fall. The Committee placed Mr Yanagida’s degree of carelessness between the mid and high range.
We referred to the revised penalty guidelines for careless riding which came into effect on December 9th, 2020.
Low range:- $250 + 4 days suspension
Mid-range:- $500 + 5 days suspension
High range:- 9 days suspension
The Committee did not identify any mitigating factors we could apply to today’s breach. Mr Yanagida’s record was not, in our opinion, good enough to warrant a reduction in penalty and his admission of the breach was inevitable under the circumstances.
Balancing up all factors, it was the Committee’s opinion that a suspension of 7 days and a monetary penalty was appropriate.
Ms Gerard and Mr Yanagida advised that after speaking with his agent any suspension could begin immediately.
