As Mr Turner admitted the breach the charge was found to be proved.

Penalty:

Balancing up all the relevant factors we imposed a monetary penalty of $300.

Facts:

Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that jockey D Turner is unable to make the contracted weight in Race 5 on 'Our Gazza'.

Mr Turner acknowledged he understood the rule and confirmed his admission of the breach.

Mr Goodwin said Mr Turner notified the Stewards that he would be unable to make the weight for his mount in race 5, 'Our Gazza'. He was 1kg over the carded weight of 56kgs and was replaced by Mr Jonathon Parkes.

Mr Turner told the Committee that he spent time in the sauna this morning and was confident at that time that he could make the weight of 56 kgs. However upon weighing himself prior to the race he soon realised that he would be over and at that point he notified Mr Goodwin.

Submissions for Penalty:

Mr Goodwin said Mr Turner’s record was not a good one with this being his third breach of the overweight rule since 26th March. He also made reference to three similar breaches from mid April to late July 2016.

Mr Turner had no real excuse for presenting overweight and said he has recently been riding comfortably at 55kgs. He said his agent books all his rides and knows not to accept rides at 54kgs.

Reasons for Penalty:

The Committee considered all of the facts and submissions. Mr Turner’s record is only fair and any penalty has to be above that of the minor infringement scale as this is his third breach of this rule in the last 120 days. We have taken into account the fact that Mr Turner was replaced by an experienced rider in Mr Parkes ensuring that the connections and the betting public were not disadvantaged by the absence of Mr Turner. We have not given any credit for Mr Turner’s admission of the breach as it was somewhat inevitable once he was weighed on the scales.
