Decision:

As Mr Doyle admitted the breach we found the charge proved.

Penalty:

Mr Doyle is suspended from the close of racing today, Saturday June 16th up to, and including, racing on Saturday June 23rd.

Charge:

Following the running of Race 1 an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that S Doyle (Octette) allowed his mount to shift in when not sufficiently clear of ANDALOU (E Lloyd) causing that runner to be checked passing the 1000metres.

Facts:

Mr Davidson demonstrated the incident using the available race videos. Mr Doyle had jumped from barrier number 3 and Ms Lloyd from barrier 2. As the field passed the 1000m mark Mr Doyle could be seen looking to his inside in an attempt to get a run closer to the rail. He pushed his mount forward but unfortunately, as he crossed in front of Ms Lloyd, he was not sufficiently clear and she was forced to take a hold of her mount.

Mr Doyle agreed with the stewards’ interpretation of the films and said he had thought he was clear of Ms Lloyd when he allowed his mount to move inwards but obviously he wasn’t.

Submissions for Penalty:

Mr Goodwin and Mr Doyle were both invited to make submissions on penalty. Mr Goodwin told the Judicial Committee that Mr Doyle’s record showed no previous careless riding breaches. He described the interference as at the lower end and submitted that a three day suspension was an appropriate penalty.

Mr Doyle acknowledged a suspension was an appropriate penalty and advised that he had no riding engagements within the next seven days. He also said he rode predominantly in the North Island.

Reasons for Penalty:

The Judicial Committee adopted as a starting point a period of suspension of five days. In this case we could find no aggravating factors however there were several factors that we believed warranted a reduction from our starting point. Mr Doyle admitted the breach and has an excellent record. His level of carelessness was towards the bottom end. The head-on video showed him looking several times towards his inside in an attempt to avoid runners closer to the rail. He was aware of his obligations before crossing another runner and could be seen hunting his horse forward in an attempt to be the required distance clear. Unfortunately Mr Doyle cut it a bit fine and as a result Ms Lloyd suffered minor interference. Taking into account all of the submissions we have reduced the penalty by two days and accordingly we impose a three day suspension.
