Jockey M Walker was charged under Rule 871 (1) (d) in that, as the rider of KASEAMOO, he allowed his mount to shift inward near the 600 metre mark forcing ULYSSES HEART (D Walker) inward into the line of ROCKINROLL (P Taylor) who had to check.

--Mr N Goodwin, Stipendiary Steward, showed and commented on the incident with the available video footage. He informed the committee that Jockey Walker was riding with vigour and at the 600 metre mark, using the whip, his mount moved inwards causing Jockey Taylor's mount to be checked. He stated that Jockey M Walker did pull off but only after the incident occurred.
--Mr C George stated that both the affected runners were entitled to their line and Jockey M Walker's actions caused this line to be affected. He believed that the incident could have been avoided by earlier action from the jockey.
--Jockey M Walker told the committee that his horse was under pressure. It rolled in on the corner and he did shift inwards. Jockey D Walker did call but he believed he did all he could considering his horse was under pressure.
--Jockey D Walker was called as a witness and agreed that he did call. He informed the committee that he was 1 ? lengths back and he did suffer some pressure from the inward movement of M Walker's mount.
--He agreed to a question from Stipendiary Steward C George that he did have to steady. He would have had to shift ground to get a clear run.
--Jockey P Taylor, called as a witness, told the committee that he was racing three back. He was asked by Mr Walker how severe the tightening was and he replied that he copped a bit! He felt his horse may have overreacted. When asked if contact was made between his mount and Jockey D Walker's mount he replied?Just a little. It was quite hard to keep a straight line. When asked by stipendiary steward George if he had sufficient room before the incident he said he did and he could not say if he made contact with the running rail.
--Jockey M Walker told the committee he believed he had done all he could when his horse moved inwards. He grabbed the rein when D Walker called and believed he gave sufficient room to those on his inside. He stated that the horse was racing for the first time in blinkers.
--Stipendiary Steward C George informed the committee that the video film clearly showed the inward movement when not sufficiently clear.
--DECISION AND REASON
--Mr Walker the committee has carefully considered the evidence placed before it. We have revisited the available film. The two horses on your inside were perfectly entitled to be where they were at that point of the race and entitled to a clear run. However, your actions, in allowing your horse to move inwards extinguished those two horses chances of a clear run. While concurring with your comment that you did pull off the committee believes that the inward movement by your mount had occurred and your actions taken happened after the tightening.
--We find the charge proven.
--SUBMISSIONS ON PENALTY
--Mr C George told the committee that Jockey M Walker was last suspended under this rule during the Auckland Cup Carnival in March 2007. He received two suspensions, one of five days and the other of seven days. Both he indicated were in Group1 races.
--Jockey M Walker has not been back riding long since time out with an injury. He felt that although two other horses were affected it was an offence at the lower end of the scale and asked for a period of suspension.
--Mr M Walker told the committee that he rides in both the North and South Island and it is his intention to chase the premiership next year. He felt it was an offence at the lower end of the scale and did not admit the breach because he believed it was one of a minor nature.
--DECISION AND REASON
--Mr Walker, the committee in coming to a decision to impose a period of suspension for this breach has taken into account that it was one at the lower end of the scale. However, two other horses lines were dictated by your actions and must, the committee believes, be best served by a period of suspension. This committee therefore suspends you from race riding after the completion of racing on Wednesday 20 June until the completion of racing on Sunday 24 June. Three riding days.
