Following the running of race 3, the “Filly Flooring Xtra 1200”, Information A12255 was filed by Stipendiary Steward, Mr Goodwin under Rule 638(1)(d). The Information stated “in that jockey D Turner allowed his mount “Rock My Soul” to shift inwards when not sufficiently clear of “Salamanca which was checked near the 850m”.
Mr Turner signed the Information stating he admitted the breach and at the beginning of the hearing confirmed that was correct and that he understood the Rule under which he was charged.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.
Using the available films from approximately the 1000m mark Mr Goodwin identified Mr Turner leading the 5-horse field racing approximately 4 horse widths of the rail. To Mr Turner’s inside and behind him was Ms Hirini on “Salamanca”. Mr Goodwin said that near the 850m Mr Turner shifted inwards when only approximately 1.25 lengths in front of Ms Hirini who was forced to check her mount. As a result, “Salamanca” then shifted out off the heels of “Rock My Soul” and jostled with “Vinnies Volley" for a few strides. Mr Goodwin conceded that Ms Hirini’s mount was over racing a little prior to Mr Turner’s inwards movement but it was clear she did receive a check as a result of “Rock My Soul” moving inwards.
Mr Turner said the films showed the head of “Salamanca” was pointing outwards which showed Ms Hirini was trying to push Mr Lammas on “Vinnies Volley” outwards and that these actions had caused her to have to check her horse. However, he agreed with Mr Goodwin’s assessment that he was only 1.25 lengths in front of Ms Hirini when he shifted inwards.

Mr Goodwin said Mr Turner had breached this Rule three times in the last 12 months – on 18 October 2018 at Woodville where he was suspended for 5 national riding days, on 19 April 2018 at Woodville (5 days) and 23 December 2017 at Awapuni (6 days). Mr Goodwin said this was a good record for a busy rider who was also getting more rides now that he was able to ride as low as 53kg. He said it was the view of the Stewards that the severity of the interference to “Salamanca” was below the mid-range of carelessness and that a period of suspension was an appropriate penalty.
Mr Turner had no comments to make other than to confirm that he wished any suspension to commence immediately after racing at Waverley on Sunday.
Reasons for Penalty:
The Committee has reviewed the side-on and head-on films of the race from just prior to the 850m. At that point Mr Turner, who is racing some 4 horse widths off the rail, can be seen to start shifting his horse inwards and in doing so it is clear he causes Ms Hirini to briefly have to steady her mount. The Committee agrees with Mr Goodwin that Mr Turner was, at best, 1.25 lengths in front of Ms Hirini when he shifted inwards. The Committee notes that, as a consequence, Ms Hirini’s mount did then jostle with “Vinnies Volley” for a few strides but believes this was also, in part, because Ms Hirini’s mount wasn’t racing kindly for her.
The Committee believes the severity of the breach is clearly in the low range and the starting point penalty is therefore a suspension of 6 national riding days. We consider Mr Turner’s record under this Rule is good because, apart from his suspension last month, the previous 2 suspensions were some 7 and 11 months ago respectively. In consideration of this, and also taking into account his ready admission of the breach, we reduce the penalty to be imposed today by 1 day meaning Mr Turner is suspended for 5 national riding days.
