Decision:

As Mr Hannam admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Mr Hannam’s license is suspended from the close of racing on Sunday November 17th up to and including racing on Sunday November 24th 2019.

Facts:

Following the running of Race 8, an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that R Hannam allowed his mount to shift in near the 100m when not clear of COLLINSTREET which was checked.

Mr Hannam confirmed his understanding of the charge and his admission of the breach.

Mr Goodwin showed four different video angles of the final stage of the race. The rear view was used to identify the position of the horses involved with COLLINSTREET closest to the rail and Mr Hannam approximately 3-4 wide. Mr Goodwin said the back-straight camera showed where LADY CARTEL lost ground rapidly and came back onto Mr Hannam’s mount. Mr Goodwin said Mr Hannam should have pulled back at this point but instead he elected to move inwards which caused the check to COLLINSTREET on the rail.

Mr Hannam said the horse in front came back quickly onto him. He couldn’t move outwards because there was a runner to his outside. Instead he looked inwards and thinking he was 1 length clear of COLLINSTREET he proceeded to move in.

Mr Hannam concurred with the Stewards saying he should have pulled back instead.

Submissions for Penalty:

Mr Hannam’s riding record showed only one careless riding charge in the last 12 months in March this year. Mr Goodwin said the stewards placed the degree of carelessness as below mid-range and submitted that a suspension was an appropriate penalty.

Mr Hannam asked the Committee to consider his good record and advised of riding commitments through until Waverley on Sunday November 17th. 

Reasons for Penalty:

It was the opinion of the Committee that today's breach was in the low-midrange. The head-on video clearly showed Mr Hannam look to his inside and then proceed to move in when not the required distance clear of COLLINSTREET. The rider of that runner was forced to check sharply backwards for several strides. We considered Mr Hannam’s very good record under the careless riding rule and his admittance of the breach. He is a busy rider and to have faced only one charge in the preceding 12 months is a reason for mitigation.

Taking into account all factors, it was our opinion that a suspension of 5 days was appropriate.
