As Mr Parkes admitted the breach we found the charge proved.

Penalty:

Taking into account upcoming riding commitments Mr Parkes is suspended from the close of racing on Friday June 20th up to and including racing on Wednesday June 25th. Race days in this period are:

21/6/14 Tauranga
22/6/14 Waipa
23/6/14 Rotorua
25/6/14 Whakatane

Facts:

Following the running of Race 8, Courtesy Ford Handicap, an Information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d) in that J Parkes (THORN PRINCE) allowed his mount to shift ground when not clear of ST RANSOM near the 300 metres tightening that runner.

Mr Neal showed head, side and rear view videos of the incident. Soon after entering the home straight on the run home THORN PRINCE (who went on to win the race) drifted outwards and took the line of ST RANSOM who was attempting to move into a gap between THORN PRINCE and I AM SAM. The rider of ST RANSOM, Mr Dee, had to take hold of his mount and change ground to the inside of THORN PRINCE to obtain a clear run.

When asked, Mr Parkes had no comment to make on the incident.

Submissions for Penalty:

Mr Neal said Mr Parkes had an excellent record with only one careless riding charge (17/10/13) in the previous 12 months. He described the careless riding breach as in the mid-range and said that while Mr Dee had to change ground he was not really in the gap when Mr Parkes moved outwards. Mr Neal said Mr Parkes rides extensively throughout the North Island.

Mr Parkes did not wish to make any submission on penalty but did advise the committee that he had talked with his agent who confirmed riding engagements at Otaki next Friday June 20th.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted as a starting point a period of five days suspension. We assessed the degree of carelessness as sitting at the mid to low level as Mr Parkes' movement outwards was gradual and only one horse, ST RANSOM, was affected. The interference was described by Mr Neal as “tightening” with the Stewards satisfied that the incident had no effect on SAM I AM who was to the outside of ST RANSOM. Therefore, in our opinion, the incident did not warrant an uplift from the five day starting point.

We have however given a discount of one day for Mr Parkes’ admission of the breach and his very good record. He is a busy rider who has only incurred one charge over the last year.
