As Mr Bradley admitted the breach we found the charge proved.

Mr Bradley is suspended from the close of racing on Saturday December 21st up to and including racing on Friday December 27th. Race days in this period are:

Facts:

Following the running of Race 3, the Capture Signs Handicap 1200m, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that D Bradley angled his mount (SITARA) out when not clear of MCLAREN (R Myers) forcing that runner out making contact with the hindquarters of FRITZY BOY (D Turner) with that runner becoming unbalanced near the 200 metres.

Rule 638(1)(d), the careless riding rule, was read with Mr Bradley confirming that he admitted the breach. Mr Goodwin then proceeded to outline the incident using the available videos.

On rounding the bend for home Mr Bradley was searching for a clear run but had MCLAREN and FRITZY BOY to his immediate outside. He angled out when not the required distance clear of Ms Myers who was dictated outwards onto the hind quarters of FRITZY BOY. Mr Goodwin explained that Mr Bradley was riding in a competitive manner but overstepped the mark on this occasion.

Mr Bradley said SITARA was travelling really well whereas the horse to his outside, MCLAREN, was under pressure. In order to give his mount every opportunity he “delicately and calmly” applied a little pressure to Ms Myers to create a presentable gap for SITARA to go on and have a chance to win the race which it did.

Submissions for Penalty:

Mr Goodwin produced Mr Bradley’s riding record which showed two careless riding charges within the preceding 12 month period. He was suspended for 4 days in November and 3 days in March of this year. Mr Goodwin explained that the incident today was not of a serious nature and while Ms Myers was hampered the interference had no bearing on the final placings. FRITZY BOY who was also involved suffered only minimal interference and in fact may have contributed a little. The Stewards’ submission was for a suspension in the vicinity of four days.

Mr Bradley told the committee that while he admitted the breach he did not “barge into” Ms Myers but rather applied a “slight squeeze” because her horse was under pressure. What made it look worse was the fact that FRITZY BOY and MCLAREN were racing in tight quarters and FRITZY BOY lay in on that runner. Mr Bradley said he would not have moved outwards if MCLAREN (R MYERS) had been travelling better and only did so because SITARA was travelling so well. He advised the committee of riding commitments through until next Saturday December 21st.

Reasons for Penalty:

The committee took into account all of the submissions and approached a five day suspension as a starting point for penalty. Mitigating factors are Mr Bradley’s very good record and his ready admission of the breach.

It was our opinion that the degree of carelessness was in the low range. Mr Bradley found himself on a horse full of running but held up by a horse battling away on his outside. Ms Myers was entitled to her line of running and Mr Bradley was certainly careless when he dictated that line however the manner in which he did so was not dangerous and the resultant interference was minor. If FRITZY BOY had not been to Ms Myers' immediate outside the incident would probably have been insignificant. We have therefore reduced the penalty to one of four days suspension.
