Following the running of Race 4, the Richard Algar Ltd Handicap S Doyle, the rider of ALMUTA WAWHO was charged with a breach of Rule 871 (1)(d) ? Careless riding.
Following the running of Race 4, the Richard Algar Ltd Handicap S Doyle, the rider of ALMUTA WAWHO was charged with a breach of Rule 871 (1)(d) ? Careless riding.
--It was alleged that Mr Doyle allowed ALMUTA WAWHO to shift out when not clear of CAN KEEP A SECRET (J Symes) which was checked and lost its rightful line of running.
--Mr Doyle, who was assisted by Mr John Donovan, admitted the breach.
--PENALTY
--Prior to hearing submissions on penalty Mr Goodwin demonstrated the incident by way of the films of the race.
--The films showed ALMUTA WAWHO improving on the inside of the field nearing the home turn. Mr Doyle has then angled him out to make his finishing run and in doing so has not been clear of CAN KEEP A SECRET and as a result has taken its line and forced J Symes to check.
--Mr Doyle has then gone on to win the race.
--Mr Goodwin presented Mr Doyle's record, this demonstrating no previous breaches of the careless riding rule.
--It was Mr Goodwin's submission that this was a breach best dealt with by way of a term of suspension. He believed that Mr Doyle had taken another runners line at a critical point in the race and as such had affected its chances.
--Mr Donovan, on Mr Doyle's behalf, submitted that this incident could simply be categorised as an error of judgement by Mr Doyle.
--As such he believed a warning was sufficient, however he did tender Mr Doyle's prospective riding dates.
--While we agree that the incident can be best classified as an error of judgement we do not concur that a warning is appropriate, and it is our view that a term of suspension needs to be imposed.
--When determining the quantum of such suspension we are mindful that this incident has resulted in a runner being checked at an important stage of the race.
--However in Mr Doyle's favour is that he has never before been charged under this rule. Also Mr Doyle has readily acknowledged his carelessness.
--Therefore after carefully considering all that we have heard we find that Mr Doyle be suspended from the conclusion of racing on Wednesday 18th April up to and including racing on Saturday 28th April 2007. (3 days)
