As Mr Lammas admitted the breach we found the charge proved.

Penalty:

Accordingly Mr Lammas is fined the sum of $200.

Facts:

Following the running of Race 2, Murray Free Contracting Maiden 1300, an Information was lodged by Mr Goodwin under Rule 636(1) (d) in that Mr Lammas being the rider of PERFECT PITCH failed to ride his mount out fully to the end of the race when there was a reasonable chance of it running into 5th position.

The Rule reads:

636 (1) A person:

(d) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;

Mr Jones used both the head-on and side-on videos to highlight the incident. In the home straight Mr Lammas was riding forward with the whip but approximately 50 metres from the finish line he eased up and failed to ride his mount out over the final stages of the race. Mr Lammas finished in 6th place with ½ head margin between 5th and 6th.

Submissions for Penalty:

Mr Goodwin said Mr Lammas has been riding for 16 years with 700 – 800 rides per season and this was the first occasion he been charged with a breach of this rule. Mr Goodwin said Mr Lammas had a momentary lapse in judgement today and the opinion of the Stewards was that the breach was at the bottom end of the scale.

Mr Lammas explained how he misjudged his position relative to the winning post and while admitting that he didn’t ride his mount out fully to the finish he said he hadn’t sat up on the horse either. Mr Lammas also said, in his opinion, even if he had ridden his horse out he doubted it would have held fifth place.

Reasons for Penalty:

The Penalty Guide for Judicial Committees provides a sliding scale for starting points of breaches of Rule 638 (1) (d). Penalties range from a starting point of 5 weeks suspension for missing first place, down to fines of $300 for failing to ride out and missing 5th placing.

Mr Lammas is a very experienced rider who has never faced a charge of this kind over a long career. He has also readily admitted the breach.

Taking into account the recommended starting point of $300 the Committee has given Mr Lammas credit for his excellent record and his admission of the breach.
