Following the running of Race 1, the Marsden Shearing Ltd Maiden, Mr. K. Smith was charged with careless riding under rule 638 (1) (d). The information alleged that K. Smith the rider of POP YA BELT permitted his mount to shift inwards near the 1000m when  not the required distance clear of METANET (D. Walker) which was dictated inwards into the line of CALIFORNIAN SMILE (M. Cameron) which in turn was dictated inwards onto LADY ATARETA (J. Parkes) which was checked.

Following the running of Race 1, the Marsden Shearing Ltd Maiden, Mr. K. Smith was charged with careless riding under rule 638 (1) (d). The information alleged that K. Smith the rider of POP YA BELT permitted his mount to shift inwards near the 1000m when  not the required distance clear of METANET (D. Walker) which was dictated inwards into the line of CALIFORNIAN SMILE (M. Cameron) which in turn was dictated inwards onto LADY ATARETA (J. Parkes) which was checked.

Mr. Smith did not admit the breach.

Mr. Goodwin called as witnesses the three riders involved in the alleged incident.

--

Mr. Parkes, the rider most affected, said his horse started well but was racing a little erratically. As he moved forward into a position on the running rail pressure came from his outside causing him to pull back and out of the gap. He was forced to check back when Mr. Matt Cameron came over when only about ¾ length clear of his mount. Mr. Parkes said that his horse’s racing manners did not really have anything to do with the interference he received.

Mr. Cameron told the committee that he was racing between Mr. Parkes (on his inside) and Mr. David Walker (on his outside). Not long after the start Mr. Walker moved inwards when only ¾ length clear shunting him inwards onto Mr. Parkes. Mr. Cameron called out to Mr. Walker but could not hold his ground.

Mr. Walker, who was riding METANET, explained that Mr. Smith shifted inwards approximately half a horse width when not the required distance clear. He said the resultant tightening was only for 2 – 3 strides and that once Mr. Smith heard the calling from Mr. Cameron he immediately pulled off.

Mr. Goodwin then showed the films of the incident. The side-on film showed the extent of the ground lost when Mr. Parkes ran out of room on the fence and the head-on view showed Mr. Smith trying to relieve the pressure but his efforts were too late.

--

Mr. Smith did not deny that his horse moved inwards setting up a concertina effect which culminated in Mr. Parkes being squeezed out of his rightful position on the fence however he said it was due to circumstances out of his control.  The first of these was the very strong wind on the day.  Combined with the greenness of POP YA BELT Mr.Smith said the wind was a big factor in the horse moving inwards.  He also said that the horse in front of him eased up which meant he too had to ease.

Decision

--

The committee had careful regard to all of the submissions put before it.  There was no doubt that Mr. Parkes was checked out of his position on the rail when Mr. Cameron came across closing a gap that Mr. Parkes was already into. His mount was racing erratically prior to this but Mr. Parkes was quite clear that this did not contribute to the interference he received.  Mr. Cameron said that he couldn’t hold his ground because Mr. Walker crept inwards from his outside and Mr. Walker said that he was forced inwards due to Mr. Smith moving in on him half a horse width.

The committee viewed the films in some detail and while they were not of a high quality they did help to clarify the incident.

--

We did not accept that the wind was the cause of Mr. Smith’s inward movement. If that had been the case we would have expected other riders to have had the same difficulty keeping their mounts straight and there was no evidence of that.  The easing of the horse in front may well have caused Mr. Smith to ease back but it should not have caused him to shift inwards.

--

Taking into account all the evidence from the witnesses and the video footage we found the charge of careless riding proved.

Penalty

--

Mr. Goodwin said that Mr. Smith had an excellent record with only one charge in recent months on 30/1/10.  He submitted that the carelessness was at the lower end of the scale and could be met by a period of suspension in the vicinity of four days.

Mr. Smith asked the committee to consider his good riding record and advised of riding commitments up to and including February 20th.

Penalty Decision

--

In coming to a decision on penalty the committee considered all of the submissions. We took into account the severity of the interference which we agreed was towards the lower end of the scale.

--

While there were three riders involved it was really only Mr. Parkes who lost ground and Mr. Smith’s shift inwards, which started the chain of events, was only slight. There was also clear evidence of Mr. Smith taking corrective action, albeit a little too late.  We also considered Mr. Smith’s very good riding record and his riding commitments in the next seven days.

He is suspended from the close of racing on Saturday February 2oth until the close of racing on Friday February 26th – in effect four days.
