As Ms Johnston admitted the breach we found the charge proved.

Penalty:

Taking into account upcoming riding commitments Ms Johnston is suspended from the close of racing on Saturday December 20th up to and including racing on Saturday December 27th. The Committee questioned Ms Johnston on whether she would be riding at Gore (21/12/14) and she replied that she would be. Mr Goodwin said that Ms Johnston does a lot of riding in the South Island and the Stewards would accept this to be true.

Facts:

Following the running of Race 7, the Lawnmaster Eulogy Stakes, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that V Johnston permitted her mount CHOICE to shift in passing the 200 metres when not clear of PALACE ROCK which was checked.

Mr Goodwin read Rule 638(1) (d) and Ms Johnston acknowledged she understood the charge and confirmed that she admitted the breach.

Although the films had been viewed extensively throughout the protest hearing (following the Eulogy Stakes) Mr Goodwin replayed the relevant parts to highlight the reasons for Ms Johnston being charged with careless riding. He said Ms Johnston moved in three to four horse-widths from the widest part of the track into the line of PALACE ROCK necessitating Mr Chris Johnson to check his mount. Mr Goodwin conceded that Ms Johnston did straighten her mount up but it was too late.

Ms Johnston said while the films were self-explanatory she highlighted the contributing factor from Mr Parkes when he had dictated PALACE ROCK outwards. This had been acknowledged during the protest hearing. It was Ms Johnston’s opinion that had PALACE ROCK not been pushed wider on the track she would have cleared that runner when she made her inward movement.

Submissions for Penalty:

Mr Goodwin produced Ms Johnston’s riding record which showed her last charge was on March 1st 2014 when she was suspended for three days. He said it was quite clear that Ms Johnston had caused interference to PALACE ROCK but the protest hearing established that it had not cost that horse a higher placing. Taking into account the status of the race, the Stewards’ submission was for a term of suspension in the vicinity of six days, but he asked the committee to take into account Ms Johnston’s very good record.

Ms Johnston thought the stewards’ submissions were too harsh, considering her very good record, but said ultimately it was up to the discretion of the Judicial Committee. She advised of riding commitments throughout the next seven days, in particular the mount on ANNIE’S STAR in the Manawatu Cup next Saturday.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted as a starting point, a period of five days suspension. The Group 3 status of the race deserved an uplift of one day to that of a six day suspension. The consequences of the interference resulted in a protest being brought but the race result remained unchanged and we did not consider that an aggravating factor. We assessed the degree of carelessness as sitting in the mid- range. The amount of ground Ms Johnston moved in from wide on the track was irrelevant as she was clear of all other horses until she reached PALACE ROCK. The films clearly showed her stop riding and straighten but unfortunately this action came 2-3 strides too late. Ms Johnston has an excellent record and we have given her credit for that as well as her admission of the breach taking her penalty down to one of four days.
