As the breach was admitted we found the charge proved.

Accordingly Mr Cole is fined the sum of $200.

Facts:

Following the running of Race 5, MacDougalls Handicap, an Information was lodged by Mr N Goodwin alleging a breach of Rule 534(2) (b) in that T Cole scratched ALTIUS from race 5 when there was no material change in the track conditions.

Mr Goodwin read out Rule 534(2) (b):

“If the Stipendiary Steward is not so satisfied, he shall complete an information and file it with the Registrar for the Judicial Committee and the Judicial Committee shall then determine whether there are such circumstances and whether the Trainer or Owner or lessee (as the case may be) or his Agent or its Racing Manager is authorised to scratch the horse after that time.”

Submissions for Penalty:

Mrs Cole told the committee they had brought two horses down to Awapuni to race today. Yesterday afternoon when Mrs Cole walked the track it was rated a slow 7. The track manager, Mr Treweek, told her he was expecting it to get to a slow 6 by this morning. There was no further rain overnight, there was a slight breeze and the sun had come out. Based on these observations, when Mrs Cole spoke to her husband this morning, they believed there was a realistic chance the track would be upgraded. After CIVETTA raced in Race 3 (and was unplaced) Mr Cole, who was watching from Te Rapa, realised that the track conditions were clearly unsuitable, and if anything, the track had become more testing. Mrs Cole told us ALTIUS is a young horse with a lot of promise and they did not want to risk his welfare. A decision was made to scratch him from Race 5.

Mr Goodwin said there had been no material change in the track conditions.

The Stewards put forward a number of other breaches of this rule where connections were fined the sum of $200.

Reasons for Penalty:

As the breach was admitted the Committee had only to consider penalty. We had particular regard to the previous penalties relating to late scratchings on race day which Mr Goodwin put forward in his submissions. While most of these cases were due to trainers believing track conditions had deteriorated we did not consider there to be any reason why we should deviate from those penalties imposed. The Coles were hoping for a track upgrade but, unfortunately for them, this did not happen.
