Following the running of Race 5, the Steelfort Maiden, Jockey K Smith the rider of SHARROW BAY instigated a protest
----
Following the running of Race 5, the Steelfort Maiden, Jockey K Smith the rider of SHARROW BAY instigated a protest alleging that his horse, provisionally placed second by the judge had its chances affected of finishing in a higher placing by the actions of the provisional winner PANACHE ridden by Mr B Herd.
----Mr McCutcheon read Rule 876(1) and reserved the right to charge.
----Mr Smith using the available films, informed the committee that he was in front of Mr Herd's mount which came up alongside. He was bumped, changed leg and lost momentum. He felt his chances had been affected.
----Mr Herd asked how far out did the alleged bumping occur. Mr Smith felt it was about eight strides from the post. Mr D Walsh told the committee that when SHARROW BAY was headed it kept to a straight line and fought back. He felt the horse was bumped about three strides from the post and believed its chances were affected.
----Mr Georgetti, the trainer of PANACHE, told the committee both horses were travelling well and he believed at no time did Mr Smith stop riding his mount.
----Mr Herd informed the committee that he made ground down the home straight and his horse did shift in but believed that SHARROW BAY had every opportunity. He was not convinced contact was made. He said in answer to a question from Mr Walsh that he did move in slightly and did take corrective action. He felt the incident occurred about two strides short of the post.
----Mr McCutcheon, Chief Stipendiary Steward, informed the committee that Mr Herd's mount was making ground down the home straight about 1-1/2 lengths in the last 200 metres. PANCHE got to the front and close to the winning post when he believed contact was made. He felt PANCHE was travelling well at the point of the incident.
----Decision and Reason
----Rule 876(1) requires the committee to ask first whether interference occurred and then if so, whether the interference has cost the horse interfered with from finishing in a higher placing.
----In the committee's view, although contact was made extremely close to the winning post PANACHE was always travelling well. It had made considerable ground down the home straight. SHARROW BAY was headed in the run to the line and although it did fight back the committee was of the opinion that its chances of finishing in a higher placing were not affected by the incident. The protest was dismissed.
