 The committee determined that the remainder of the meeting be abandoned.

Facts:

Prior to the running of Race 7 (Swap Stockfoods Manawatu Breeders Stakes), Information A4032 was filed with the Judicial Committee. The information was seeking a Request for a Ruling in relation to Rule 902(2)(a)(ii) and stated: "The stewards seek a ruling as to whether the remaining two races should be run due to some concerns regarding the racing surface near the 800m and that the meeting be abandoned".

Rule 902(2)(a)(ii) provides: "for a judicial committee to determine any question as to whether that day of racing or any part thereof should be postponed, abandoned or cancelled."

Submissions for Decision:

Stipendiary Steward Neil Goodwin confirmed that all riders were present in the judicial room for the hearing. He then proceeded to advise that a horse had slipped at the 800m in race 6, and a subsequent track inspection had taken place. He submitted that the inspection identified slip marks that were quite evident and that Mr M Du Plessis, whose horse had been the one that slipped, had advised that his horse did slip free from interference. He also stated that Mr Tinsley's view was that the meeting should continue as he had had some previous involvement with Mr Du Plessis' mount and he believed that it was not a sure-footed animal. Mr Goodwin submitted that he had spoken with some of the senior riders and that the consensus was for the meeting to be abandoned. He confirmed that this was also the view of the stipendiary stewards as the track was not safe and that there was a lack of full opportunity due to the unsafe nature of the track. Mr Goodwin also stated that the track had been 'shifty' all day.

Mr Du Plessis used the back-straight film to identify the point where his mount slipped. He stated that the film did not necessarily show the full extent of the slipping as he was racing between horses. Mr M Hills, who was racing directly behind Mr Du Plessis stated that he observed Mr Du Plessis to slip quite badly and that he was lucky that he had been racing between horses to hold him up.

Mr N Harris submitted that throughout the day a few of the jockeys had commented on the state of the track. He had not had a ride, but based on the evidence of Mr Du Plessis, Mr Harris believed that due to the state of the track, riders would not be able to ride to their full extent. Mr D Bradley confirmed that he had slipped earlier in the day and had voiced his concerns to the stewards. He believed it would be difficult for riders to ride competitively and with vigour under these circumstances.

Trainer Mr G Vile had inspected the track and had seen a slip mark near the 800m. He submitted that as the Trainers' representative he was supportive of the concerns expressed by the jockeys. 

Club officials had nothing further they wished to say.

Reasons for Decision:

The decision to call off a race meeting is never taken lightly. The Judicial Committee recognises the many people who are affected by such a decision including trainers, owners and horses who have travelled down from the Northern area for today's Group Three race. Any decision to abandon a race meeting must be fact-based and the committee was satisfied, based on the evidence placed before the committee, that concerns regarding safety were clearly established. Senior riders Du Plessis, Harris, Hills, Bradley and Riddell, along with others, had substantiated these concerns during the hearing. Club officials and the Trainers' representative Mr Vile, concurred with the view submitted by the stipendiary stewards. Regardless of the status of the race, in this case a Group Three one, the committee determined that the safety of those involved was of paramount concern.
