Decision:

At the Manawatu Racing Club meeting on 11 April 2008 Information 6665 was filed pursuant to Rule 828 (1) alleging that Mr F Finnegan being the trainer of PUAN SILK failed to scratch the horse by the required time.

Mr Finnegan admitted the breach of the rule.  Stipendiary Steward Mr Davidson advised the Committee that he told Mr Finnegan that he should attend the hearing but confirmed that Mr Finnegan had elected not to do so.

Mr Davidson said that Mr Finnegan had rung the Bureau at 7.37am today (11 April) to scratch PUAN SILK.  He was advised that he was seven minutes late.  Mr Finnegan then rang Stipendiary Steward Mr Goodwin to say that he wanted to scratch the horse.  Mr Goodwin advised him he was late and that the horse should still start in race 2.  Mr Finnegan said that he needed to speak to the owner of the horse, did so and rang the Bureau at 7.55am to advise the horse was scratched.  Mr Davidson advised that because of this late scratching a balloted out horse was denied a start that it would otherwise have had if PUAN SILK had been scratched before the 7.30am deadline.

Mr Davidson produced Mr Finnegan’s record and said that Mr Finnegan had last been charged under this rule in May 2007 when he was fined $300 and had had two other charges under the rule in June 2006 ($300 fine) and November 2006 ($200 fine).  He said that normally a fine of $200-$300 would be appropriate but pointed out that because of Mr Finnegan’s actions a balloted out horse didn’t get a start.

The Committee considered the submissions and in particular noted that Mr Finnegan had not breached this particular rule in the past 11 months but that his actions had denied a balloted horse the opportunity to race today.  The Committee imposed a fine of $400.
