BURT MONRO, who had finished 5th, was promoted to 4th placing.

Facts:

Following the running of Race 4 (T Market Fresh Handicap Trot) Information A4455 was filed with the Judicial Committee. It was alleged that GREY STOKE galloped in excess of 50m inside the final 200m.

Rule 870(3) provides:
Any horse which breaks from its gait shall promptly regain its proper gait.

Breaking Horse Regulation (b) provides:
Any horse which breaks from its gait within the final 200m of any race and continues on in the break for a distance of 50m or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

ii Disqualify it from the race under Rule 1003(2).

The Judge’s placings were:

1st - LOKI BROGDEN
2nd - ONE NIGHT OUT
3rd - CLIFDEN CLOWERS
4th - GREY STOKE
5th - BURT MUNRO

The official Margins were: 2 ¼ L, 3 ¾ L, 1 ¼ L, 1 ½ L.

Mr Ydgren showed all film replays and said that GREY STOKE broke its gait early in the straight and continued to gallop until the conclusion of the race and had galloped in excess of 50m inside the final 200m. He concluded by saying that the horse should be disqualified.

Mr Ferguson, representing the connections of GREY STOKE said that he agreed with Mr Ydgren and that he (as the Driver) could not do anything about it (galloping).

Reasons for Decision:

It was clear to the committee that GREY STOKE had galloped in excess of 50m within the final 200m and in accordance with the Rule and Regulations, GREY STOKE was disqualified.
